Xtreme Outdoor Product Recalls Climbing Sticks

On June 6, 2019, Xtreme Outdoor Products (XOP) issued a recall for their climbing sticks. According to the recall issued by XOP (recall number 19-134), the climbing sticks can suddenly break due to a bolt failure on the center step of the product; this poses a fall hazard as well as the risk of innocent consumers suffering serious injuries. The recall has affected approximately 1,165 products. The recall issued by XOP includes the XOP climbing sticks used to climb trees. These climbing sticks have both XOP and XOP-LMO4-SR printed on the box. The climbing sticks were sold in 4-packs in the sand ripple green color. The climbing sticks measure approximately 36 inches tall; the climbing sticks have three climbing steps. The defective climbing sticks were sold through the following: Webb’s Sporting Goods, TrailCam, Scheel’s in Omaha, Neb., Overland Park, Kan., and XOPoutdoors.com. The defective climbing sticks were sold between November 2018 and December 2018 for approximately $170.

Xtreme Outdoor Product Recalls Climbing Sticks - Fall Hazard and Risk of InjuryThere have been at least two separate reports of injuries caused by the defective climbing sticks. Some of the injuries reported include scrapes, bruises, and fractures (specifically a fractured foot and fractured ribs). What should consumers do after becoming aware that the products that they purchased were included in the recall? According to the recall issued by XOP, consumers should stop using the recalled products immediately and return them to XOP – for a full refund or for store credit. Although this suggestion is useful for consumers who purchased the defective product but did not suffer any injuries, following this suggestion could be problematic for any consumers that suffered injuries due to the defective product. If you were harmed in any way due to the defective product, you must not follow the recommendations established through the recall issued by XOP. Instead, it is essential that you seek legal assistance immediately. If you suffered injuries due to a defective product, you should never follow the suggestions of the company – as this could deprive you of your right to take action against the company for the harm that you suffered. Understanding the Danger Associated with the Defective Product

The XOP climbing sticks are used to climb trees. These sticks come in four-packs. In general, consumers use multiple of these sticks to gain elevation and get higher up the tree. The center step of the climbing sticks (sticks have three steps each) can suddenly break due to a bolt failure. This could cause unsuspecting victims to suddenly fall while they are climbing trees, meaning that victims could fall many feet down to the ground. Depending on the fall, victims could be left suffering from a number of injuries, including sprains, fractures, and lacerations, for example. Some of the most severe injuries that could result from a fall while climbing trees using the defective product could include neck injuries, back injuries, brain injuries, and spinal cord injuries, for example. Did you suffer any of the harm mentioned above? If you would like to learn more about your right to take action against XOP after you were harmed due to their defective product, do not hesitate to contact our law firm as soon as possible. Our lawyers will provide you with all the information that you need to understand your right to pursue a claim.

Can You Pursue a Claim?

You Could Sue and Receive Compensation Do you have a right to pursue a claim if you were harmed by a defective product? If the defective product had an issue in design, labeling, or manufacturing, you will likely have grounds to pursue a claim. What establishes your right to pursue your claim? This right is based on the specific duty of care that you are owed by all companies. All companies, including XOP, have a duty of care to their consumers. They must ensure that their products are safe for consumers to use before making them available for purchase. To ensure that their products are safe for consumers, they must thoroughly inspect products for hazards, identify hazards, and address hazards prior to making products available for purchase. If companies fail to identify and address hazards in their products before making them available for the public to purchase, they are negligently putting their consumers at risk of injury – and they could be held accountable for all the harm caused by their defective products.

You Could Sue and Receive Compensation

As described above, you have the right you pursue a claim. If your product liability claim is successful, you might be eligible to recover compensation. How much compensation could you receive? What could you recover? What type of compensation could be available for recovery? The answer to this question depends on the specific details of your claim. In general, the categories of compensation available for recovery include the following:
  • Medical expenses
  • Lost wages
  • Pain and suffering
  • Property damage
  • Punitive damage
If the defective product resulted in the death of the victim, surviving family members might be eligible to receive compensation for funeral/burial expenses and the loss of consortium in addition to the other compensation mentioned above. If you would like to learn more about the specific type and amount that you might be eligible to recover if your defective product claim is successful, do not hesitate to contact our experts as soon as possible. Our lawyers will provide you with all the information that you need and will fight for your right to recover the maximum amount of compensation available for your claim. If you are ready to learn more about the compensation that you could recover if you win your claim, do not hesitate to contact our firm immediately.

How Long Do You Have to Sue?

Undeniably, you have the right to file a claim and receive compensation if your claim reaches a successful outcome. However, you can lose your right to sue if you fail to take action within the appropriate length of time. How long do you have to file your claim? Product liability claims in the state of California are generally subject to a two-year statute of limitations. This means that the parties affected by defective products only have two years to file their claims. What happens if claims are not filed within the appropriate statute of limitations? Failing to file a claim within the statute of limitations will undoubtedly result in losing the right to sue. Because it is possible to lose the right to sue, it is essential that you discuss your claim with an attorney to ensure that you have a thorough understanding of the deadlines that apply to your claim.
