TerraTrike Recalls Adult Tricycles-Product Liability Attorneys

TerraTrike Recalls Adult Tricycles-Product Liability Attorneys On December 18, 2018, TerraTrike recalled their TerraTrike Rambler E.V.O adult tricycles due to crash and injury hazards. According to the recall (recall number 19-052), the torque sensor in the wheel of the TerraTrike Rambler E.V.O adult tricycles can activate unexpectedly, causing the trike to power forward and creating a risk of crashes and injuries. According to the recall, approximately 450 units were affected. The recalled TerraTrike adult tricycles were sold from August 2107 through October 2018 at authorized TerraTrike dealers, recumbent bicycle specialty stores, independent bicycle dealers, and online viva TerraTrike’s website for approximately $3,500. Although no injuries have been reported, TerraTrike has received at least five reports of the torque sensor activating and causing the trike to power forward. The recall recommends that consumers with the recalled adult tricycles stop using the product and visit the place of purchase for both a free speed sensor installation and a software upgrade. The recall claims that there have been no consumer injuries, but it is possible that there have been unreported injuries. Do you own the recalled adult tricycle? Have you experienced the sudden activation of the torque sensor? Has the defect resulted in a crash? Did you suffer any injuries as a result of the crash? If you suffered injuries due to the defective adult tricycle, you might have grounds to pursue a personal injury claim. You could file a defective product or product liability claim against the company responsible for making the defective adult tricycles available to the public. If you or members of your family were affected by the defective TerraTrike adult tricycles, our law firm could help you file a lawsuit. You might also be eligible to participate in a class action lawsuit against TerraTrike. Are you interested in learning more about your right to pursue a claim against TerraTrike for the injuries that you sustained? If so, you should contact our law firm as soon as possible. The company claims that there have been no injuries due to the defective product that they negligently made available for consumer purchase. However, anyone who used the defective adult tricycles could have suffered a number of injuries. Some injuries commonly associated with such hazards are listed below:
  • Head injuries
  • Traumatic brain injuries
  • Foot injuries
  • Ankle injuries
  • Leg injuries
  • Arm injuries
  • Hand injuries
  • Wrist injuries

  • Ligament damage
  • Muscle damage
  • Broken bones
  • Hip, knee, shoulder injuries
  • Scrapes, cuts, and bruises
Without a doubt, the severity of the injuries sustained depends on a number of factors, including the force of the collision and the location of the collision, for example. If you suffered an injury or a combination of injuries, you might have grounds to pursue a claim. Your Eligibility to File a Claim

Could you file a claim against TerraTrike for their defective adult tricycles? To be eligible to file a defective product claim, the product must show at least one of the following: a defect in design, a defect in manufacturing, or a defect in labeling. Although the recall does not specify what type of defect is causing the sensor to power unexpectedly, it is possible that it is due to a defect in either design or manufacturing, for example. Why could you sue? Companies, such as TerraTrike, must ensure that their products are safe for the public prior to making their products available for purchase. When TerraTrike made their defective adult tricycle available for consumers, they were breaching their duty of care and creating an avoidable risk of injury. For more information about whether you can sue for the injuries that you suffered, do not hesitate to contact our product liability attorneys at Downtown L.A. Law Group. Our lawyers will provide you with all the information that you need to better understand your right to pursue a claim.

Your Right to be Compensated

Could you recover compensation? If your defective product claim is successful, you will likely be eligible to recover some sort of compensation. How much compensation could you receive? What type of compensation could you receive? Every claim is different; however, some product liability claims result in claimants recovering some of the following types of compensation:
  • Medical expenses
  • Lost income
  • Pain and suffering
  • Loss of consortium
  • Punitive damages
If the injuries sustained due to the defective product are so severe that the victim loses his or her life, claimants could be eligible to receive compensation for funeral and burial expenses. Regardless of the specific details of your defective product claim, you could be certain that our lawyers will fight for your right to recover the maximum amount of compensation available for your claim. If you would like to learn more about the specific type and amount of compensation that you could be eligible to receive, do not hesitate to contact our attorneys at your earliest convenience.

Preparing for the Claim

If you are injured due to a defective product, it is essential that you prepare for the claim. Once again, consider the information on the recall. The recall recommends that consumers who own the recalled tricycles visit the locations where they purchased them for a free repair and free software update. If you suffered injuries and then followed the recommendation to get the tricycle repaired/updated, you might lose the most important piece of evidence for your claim. When you are preparing to file a claim, there are many things that you should do and many things that you shouldn’t do. Consider the following:
  • You should seek medical attention for your injuries as soon as possible.
  • Keep all records of the medical expenses associated with the injuries caused by the defective product.
  • Do not tamper with the defective product in any way after being harmed.
  • Do not take the defective product in for a free repair or agree to a refund or exchange.
  • Keep all records associated with your purchase of the defective product.
If you would like to learn more about the things that you should do in preparation for your defective product claim, do not hesitate to seek legal assistance as soon as possible. Seeking legal assistance is one of the most important things you could do to ensure the success of your defective product claim.

Understanding the Statute of Limitations

Understanding the statute of limitations that applies to your claim is an essential part of pursuing a defective product claim. A statute of limitations determines the specific length of time that you have to pursue your claim. If you do not file your claim within the time limit allowed by the statute of limitations, you could lose your right to sue and receive compensation. In general, defective product claims are subject to a two-year statute of limitations. However, there are many exceptions that could apply-resulting in a lengthened or shortened deadline to pursue a claim. If you would like more information about the statute of limitations that applies to your claim, do not hesitate to contact our law firm today.
