Snapper Riding Mowers Recalled by Briggs and Stratton

On November 14th, 2019, Briggs and Stratton issued a recall concerning its Snapper Rear Engine 33″ Riding Mowers. The reason is due to an engagement lever; the blade of the mower can remain engaged and active after the foot-activated disengagement pedal is deployed. About 1,160 of the units were recalled. The mowers can be identified by the location of the engine, which is located in the rear, and the height of the deck, which is 33″ above the ground. The mowers are red and black in color and have the model number 2691526. The name of the company, Briggs & Stratton, is located on the rear of the mower, as well as the numbers 33″. The word Snapper is on the front of the mower. Snapper Riding Mowers Recalled by Briggs and Stratton The mowers were manufactured in the United States, in Wisconsin, and distributed by various Snapper dealers around the country from March 2019 to May 2019. They cost roughly $2,560. There have been no accidents reported and no injuries have occurred due to the faulty engagement lever. In spite of this, it is recommended that customers stop using or riding the mower and do not permit anyone else to do so until an inspection and repair has been completed. Customers can contact Briggs and Stratton to schedule an appointment.

Injuries from Mower Accidents

Mower accidents can happen when a blade is broken or when the blades do not lock from a mechanism or lever. Generally, the blades will stop ceasing when the gas is not deployed or when the pedal is not depressed. The blades should not always be spinning when the mower is on because many people ride them over other surfaces besides grass, and the results could be devastating. Others will simply go underneath to clear some debris or hard materials from the blades. If a spinning blade does not disengage or slow down, it can cause extreme injuries. Some of these injuries include:
  • Severed limbs and digits
  • Lacerations
  • Cuts
  • Organ damage
  • Blood loss
  • Scarring
  • Permanent disfigurement
  • Internal bleeding
  • Nerve damage
  • Torn or shredded muscles
  • Paralysis
  • Numbness
  • Death
Riders are not the only ones who are at risk in these situations. Some mower riders will work with other people, such as those who are in landscaping. Partners who are cutting weeds or laying sod and seeds may be caught off guard and suffer injuries from a blade. Children can also be hurt if they are playing nearby when someone is using the mower or if they are tasked with mowing the lawn. Further, if the mower is being cleaned, the cleaner can be hurt, as well. There are numerous ways that individuals can be injured. Filing a Product Liability Claim against Briggs & Stratton for a Defective Mower

In order to file a product liability claim, you will have to prove that the company was negligent in some way. Briggs & Stratton likely made an error with the mower when they were designing them or when they were creating them. Product liability lawsuits can be filed in the following scenarios:
  • When a company has a design flaw with a product that causes it to be doomed to malfunction from the very beginning
  • When the company’s manufacturing contractor or internal manufacturer makes an error with the product or when one of the machines creating it malfunctions
  • When there are no hazard or warning signs present on the item or on the packaging of the item
Lawn mowers should not need warnings on them to protect people, as users know the blades are extremely dangerous. However, there should also be the knowledge that they are safe and that the blades will not continue spinning after they have been locked. If a lever disengages despite appearing locked, there was likely n error in the creation of it, such as a screw that was not properly affixed or a material that was not strong enough to hold, or a design error that meant the latch could not hold under pressure. In either event, you will have the foundation you need to move forward with your case. You will need appropriate evidence to file a product liability lawsuit. We recommend taking these steps to ensure that you have adequately prepared for your claim: First, go to the doctor to get medical treatment. Time is of the essence, especially with a serious injury. If you need to call the ambulance to rush to the emergency room, do not hesitate to do so. If you do not go to the doctor immediately, you may suffer additional damages or you may not properly heal. It is also important that you go to the hospital fast so that the insurance agent does not deny your claim because of the gap in time. He will consider the possibility that you were hurt elsewhere if the gap is significant. Further, while at the hospital, make sure to ask for copies of your receipt and payment, as well as any notes the doctor made and prescriptions you received. Next, you may need to ask any bystanders or eyewitnesses if they saw the incident happen. If so, you can add their testimonies and statements to your claim. In some cases, other individuals could have been hurt by their own lawn mowers. You may be able to start a class action lawsuit against the company if numerous people were injured because of the defective blade levers. Be sure not to tamper with the mower in any way. You may try to fix it or tae it somewhere to be fixed, but this is an error. If you do, the company can claim that there were problems that were caused after you began tinkering, and it will be impossible to tell what was a problem. By the same token, you should not return the mower to the store. If you do, or if you throw it out, you will not have the main piece of evidence for your case. It is extremely important that you hold on to the mower at all costs and take photos and videos of it to illustrate the defect. You will need to produce copies of your receipts and proof of purchase documents, or bank statements showing you bought the mower. With all of this evidence gathered together, you will be well prepared to sue. You should always look for legal representation, though, as you very likely do not have the necessary legal experience required to go through with the claim. There will be a lot of negotiations and attempts to prove liability, and you might not be able to spend a lot of time or effort on it. It is wise to look for a product liability attorney who can help you win your claim.
