Skylight Issues Recall for Series I Power Adapters

Skylight sold a number of Series I power adapters with its photo frames that digitally lit up or had scrolling images display across the glass. The adapters were recalled because the casing could break when it was plugged into an outlet or power strip, which would expose the metal conductor prongs and cause an electric shock hazard. The recall was issued on November 7th, 2019. Over 65,000 units were recalled by the company. How can I file a product liability claim against Skylight? The power adapters were sold with the digital frames and can be identified by the UPC code on the packaging (679113611535). All adapters are black in color with a circle-shaped indentation on the side of it. Other frames included different types of adapters, but only the Series I adapters are to be recalled. The power adapters and frames were manufactured in China and imported by the parent company of Skylight, Glimpse, into California. They were sold at SkylightFrame.com, Amazon.com, and Von Maur stores across the nation. They were on sale from April 2018 to March 2019 and cost $160 as a package. To date, there have been 8 reports of adapters breaking or malfunctioning, exposing the interior metal prongs. Of these 8 reports, only 1 has resulted in an electric shock and injury. To counteract the potential problems, Skylight has requested that consumers refrain from using the adapters anymore. The individuals can contact the company to determine how to dispose of them. The company is contacting known users directly and offering a free replacement adapter that does not have the defects the Series I adapter has.

What kind of injuries can happen from a defective power adapter?

A defective power adapter can be problematic for many reasons. For one, it is possible that there can be a fire that can start from exposed metals that are in outlets. If you leave the picture frame plugged in overnight or while you’re away on a trip, you stand the risk of a small electrical fire starting. This can of course be devastating if not contained immediately and can cause serious injuries and even death. Other less serious incidents can occur as well. When the adapter is plugged in, small children could go near the wires and suffer shocks. You also could be shocked if you try to remove the adapter from the wall without turning it off or without cutting the power to the strip. Electric shocks and electrical burns can cause various damage to the skin and nerves. Burns in particular can be very painful and cause the skin to blister and lose sensation. The scarring that can result from such damages may be permanent and never fade. You may require numerous surgeries and treatments, such as skin grafts, to help you along in the recovery process. How can I file a product liability claim against Skylight?

If you wish to file a product liability lawsuit against Skylight for injuries suffered from a defective power adapter, you will need to show that the company was negligent or responsible in some way. To do this, one of three points must be proven. These points are as follows:
  • The item had a design flaw present from the creation of it
  • There was a manufacturing error that caused that batch of items to be wrongly produced
  • There were no warnings or hazard markings on the item or on the packaging to warn customers
Because these power adapters came with photo frames, and only a certain type of adapter is affected by the recall, there was likely a manufacturing error at a plant that caused a large order of the adapters to malfunction. Proving this can be difficult, though, if you have no legal experience. You should strive to gather as much evidence as you can of the incident and the defective item. Skylight Issues Recall for Series I Power Adapters The first step you should take should be to go to the doctor to get medical treatment. You should not wait too long to go get treatment because your injuries could worsen and the agent could deny your claim. A large gap between the damage and the treatment could mean that you were hurt elsewhere and you are simply trying to capitalize on the defective item. It will also be wise of you to hold on to medical receipts and doctor’s notes. You should have photos of the injuries, the item, the fire or shock, and other damages that you can show. If there were any vides that were taken of the incident, such as security footage in your home or in an office, you could add this to your claim as well. It is very important that you do not return the item or seek a refund from the company. If you do, you will lose your key piece of evidence, and you will not be able to show how the adapter had a defect. Similarly, you should not try to fix the adapter yourself, take it to a repair shop, or do anything to tamper with the item. If you do, the company can claim that it is impossible to detect the previous defect and that you very well may have caused the issue in the first place. If anyone saw the incident happen or also experience a defective power adapter from Skylight, you should write down their statements and testimonies in your case. The more perspectives you have to support you, the better your claim will go. This evidence can then be put together and submitted to an attorney. We will organize it, hire expert witnesses to further support your case, and send it ot the insurance agency representing Skylight. We will work to negotiate a fair deal from them, as insurance agents are notorious for trying to cut low deals and ensure that they do not pay out anything at all. How long do I have to file a product liability claim against Skylight?

In California, you have 2 years from the date of the injury o take legal action against the company if you were harmed because of a defective product. If you fail to sue within that time period, you will be unable to collect any compensation in the future and your claim will be thrown out. It is important that you act quickly, as your evidence can corrupt over time or get lost. There are a few exceptions to the statute of limitations. You may have been underage when the incident happened, and the statue would begin when you turn 18 years old. You may also have been left incapacitated afterwards, such as in the case of a fire. The statute would thus start when you return to health. Further, the defendant must be present in the state if you wish to sue him. If he has vacated or left, the statue will be suspended until he returns. Many claims are not filed simply because individuals do not know how much time remains on their claims. We will make sure that your documents and lawsuit are submitted on time and that there is no chance that anything will be late.
