Fluidfreeride Recalls Electric Scooter Products

Fluidfreeride (stylized as fluidfreeride) issued a recall for its Mercane WideWheel Electric Kick Scooters on October 4th, 2019. The scooters were recalled due to defective brake caliper. The caliper could fail to engage or altogether detach from the scooter, leading to a loss of control and an accident. 1,800 of the scooters were recalled, as well as an additional 66 in Canada, after the company received 15 reports of broken brake calipers. 4 of the reports resulted in injuries to the riders, including scrapes bruises, ankle damage, and back damage. Fluidfreeride Recalls Electric Scooter Products The scooters are electrically powered and operate similarly to the Bird and Lime scooters that line the streets. Fluidfreeride’s recalled scooters are foldable, though, and come in the color gray. They are made of aluminum alloy and their wheels are 4 inches in diameter. The platform on which the user stands bears the inscription of WideWheel and Mercane. All scooters have 500W motors with an 8.8Ah battery or dual 500W motors with a singular 13.2Ah battery. The products were sold at various locations, including online at fluidfreeride.com, Amazon, and Ebay. They were sold from October 2018 through September 2019 at a cost between $1,000 and $1,200. They were manufactured in China and imported by Leitmotif Services in Miami, Florida. Fluidfreeride is contacting all of its known consumers to recommend a repair. Users should refrain from using the scooter and keep it folded up until it can be fixed by the company. All repairs are free of charge.

What kind of injuries can happen in a Fluidfreeride scooter accident?

Scooters are becoming more and more popular as time goes on. They were initially a kid’s item when they entered the scene as a fad, but they became more relevant as Segway began to create large versions of them. Now, there are many companies that have scooters on the streets for commercial use. However, other companies still sell the scooters for private use. Electric scooters are generally fairly safe, but there are many ways that they can be defective. The motors and batteries could break at any time and short circuit, while the wiring could be faulty. The Fluidfreeride models have brake calipers that do not lock on some models, which can make people lose control. It can be extremely dangerous to lose control of a scooter in some areas, such as busy streets and sidewalks. A scooter accident because of a faulty brake caliper can result in broken bones, spinal cord damage, concussions, traumatic brain injuries, sprains, dislocations, internal organ damage, and much more. These accidents may lead to long-term or permanent damage if not dealt with immediately.

How can I sue Fluidfreeride for a defective scooter accident?

In order to sue Fluidfreeride because you were injured from a defective scooter, you must establish that there was some fault on the behalf of the company. Product liability claims require that you prove negligence in the form of a design flaw, manufacturing error, or failure to warn error.

Design flaws are present when the item is being created and illustrate a fundamental issue that will cause the product to fail. Manufacturing defects are generally due to the quality of parts that are used or because of the machinery that is used to manufacture or assemble them. Failure to warn errors are committed when there is no hazard sign on the packaging or on the item itself. The scooters likely suffered a manufacturing error that caused them to not work as properly as they should have. The brake calipers could have been used from a bad batch, as well. The fact that only 1,800 were recalled gives credence to the likelihood of it being a manufacturing error. To file your lawsuit, you will need evidence of the defect and proof of your damages. You can follow this procedure to ensure that you are prepared to sue: Get medical attention and hold on to any doctor’s notes, medical receipts, and treatments. You should not wait too long to go to the doctor. If you do, you may worsen your injuries inadvertently. You may also run into trouble with your claim: a gap between the injury and the treatment can be a red flag to the insurance agency. They may claim that you were injured in a separate incident and you are merely blaming the damages on the scooter. To avoid these pitfalls, go to the doctor at once. How can I sue Fluidfreeride for a defective scooter accident? Take ample photos of the damages you suffered, the scene of the incident, and the defect present on the scooter. Do not return the scooter to the company, get it repaired, take it anywhere else to be repaired, or try to fix it yourself. If you do, you will not have the ability to file a claim. If the scooter’s defect is no longer present or it has been altered, the company can claim that there is no way of knowing what the issue was or what the real cause was. You do not want to sabotage your own claim. Collect any eyewitness reports or statements from anyone who saw the incident, as they will help improve your claim. If other individuals saw the accident, you will have a better chance of success. You should make copies of any documents of purchase, receipts, and more to show that you legally bought the scooter. After you have gotten all of your evidence together and held on to the scooter, you should reach out to a lawyer with experience in product liability lawsuits against Fluidfreeride. Our lawyers have been handling product recall cases for years, and we believe that companies should be held accountable if their faulty products cause any injuries to consumers.

How long do I have to file a product liability lawsuit against Fluidfreeride?

In California, all personal injury lawsuits have a 2-year statute of limitations. If you fail to sue within that time period, you will be barred from receiving future compensation and your claim will be thrown out. It is important that you gather your evidence and file a claim while you have time. If you wait too long, a lot of your evidence can become corrupted or get lost. Many individuals do not file their claims within an appropriate amount of time and wind up with no way to get compensation. They may not know there is a statute of limitations at all, or they may simply forget about the time limit. There are some cases, though, where the statute of limitations is extended beyond the deadline of 2 years, at times indefinitely. The most common causes for the extended statute include victims who were underage at the time of the incident, individuals who were left physically or mentally incapacitated and unable to sue after the incident, and individuals who cannot sue because the defendant is not present in the state. In all cases, the statute of limitations will resume when the situation returns to normal; that is, legal age, functioning health, or presence of both parties in the state. To ensure that your case is filed within the appropriate amount of time and you do not miss the chance to receive restitution, contact our firm. We will take care all of the necessary documents and see to it that your lawsuit is filed well before the deadline.
