Rite Aid Issues Recalls for Folding Patio Chairs

On August 29, 2019, Rite Aid issued a recall that affects approximately 18,000 units of their folding patio chairs. According to the recall (recall number 19-193), the frame of the folding chair can bend and cause the party sitting on the chair to suddenly fall – this poses a significant risk of injury. The recall specifically involves two types of folding patio chairs with metal frames and padded seats sold in two colors (tan and gray). The affected chairs have the following UPC numbers and item numbers: UPC 011822956628 and item number 9043325-MMXIX (tan chair); UPC 011822952361 and item number 9044998-MMXIX (gray chair). These numbers are printed on the packaging of the folding chairs. Rite Aid Issues Recalls for Folding Patio Chairs - Fall and Injury Risk The defective chairs were sold nationwide at Rite Aid stores and online at RiteAid.com from February 2019 to June 2019 at approximately $30 each. The chairs were manufactured by Zhejiang Sains Outdoor Products Co., Ltd.., of China. According to the recall, there have been at least four reports of the folding chairs suddenly bending; there has also been at least one report of a laceration injury and a bruise. The recall suggests that all consumers who own the folding patio chairs immediately stop using the chairs and return them to a Rite Aid store for a full refund.

Without a doubt, consumers who own the chair – but who haven’t been affected by the defect – should follow the suggestion of stopping the use of the chair and returning the chair to a Rite Aid store for a refund. Although everyone should stop using the defective product immediately, parties that suffered any harm as a direct result of the defective chair should not even consider returning the product to a Rite Aid store. On the contrary, parties that have suffered harm in association with the defective product should explore the possibility of taking legal action against Rite Aid. Did you or a member of your family suffer any injuries as a direct result of the defective product negligently made available for consumers to purchase? If so, you might have grounds to pursue a claim. The Significance of Fall and Injury Risks Associated with the Defective Chairs

The Significance of Fall and Injury Risks Associated with the Defective Chairs - Rite Aid Issues Recalls for Folding Patio ChairsAs explained above, the defective product has only resulted in a minor bruise and a laceration. However, just because the reported injuries seem to be insignificant, we cannot disregard the possibility of victim suffering severe injuries. It is possible for unsuspecting parties to suddenly fall and suffer a number of injuries, including but not limited to the following: head injuries, sprains, strains, and fractures, for example. Although falling from a chair might not seem like something to worry about, a fall can potentially lead to injuries. Regardless of how minor the injuries suffered appear to be, it is important that injured parties and other affected parties are aware of their right to hold the liable parties accountable for their actions and pursue claims.

Product Liability and the Duty towards Consumers

Based on product liability, companies have to ensure that all their products are completely safe for their intended use prior to making their products available for purchase. More specifically, all companies have a duty of care towards their consumers. They must ensure that their products are safe for their consumers. This means that companies are responsible for subjecting their products to many tests and inspections to ensure that any hazards present in their products are identified and addressed prior to allowing consumers to access their products. When companies fail to take the appropriate action to ensure that their products are safe to be used, they can contribute to the harm that their consumers suffer.

Do I Have the Right to File a Product Liability Claim?

Based on product liability, injured parties have the right to pursue product liability claims given that the harm that they suffered was a direct result of a defect in a product’s design, labeling, or manufacturing. According to the recall, the metal frame of the folding chairs can suddenly bend. Affected parties will likely have grounds to sue, if the defect is associated with poor design or poor manufacturing (i.e. using subpar materials). If you would like to learn more about your right to sue Rite Aid if you or a member of your family was injured by the defective patio folding chairs that have since been recalled, do not hesitate to contact our law firm immediately to discuss the possibility of pursuing a claim. Our defective product experts will lead you every step of the way.

Could I Recover Compensation?

If you suffer any type of harm due to a defective product, you could be eligible to recover compensation. How much compensation could you recover? What type of compensation could you receive? In general, the type and amount of compensation that you are eligible to receive will always depend on the details of your claim. Some of the compensation that might be available for recovery could include the following: medical costs; lost earnings; pain and suffering; loss of consortium; punitive damages. When you allow the experts at our law firm to handle your product liability claim against Rite Aid, you can be certain that there will always be someone aggressively fighting for your right to sue and recover compensation. Our product liability lawyers are dedicated to helping you recover the maximum amount of compensation available for your claim.

Is My Claim Subject to a Statute of Limitations?

All personal injury claims, including defective product claims, are subject to statutes of limitations. A statute of limitations determines the length of time that determines the specific length of time that claimants have to pursue their claims. If claims are not filed within the timeline established by the statute of limitations, claimants will lose their right to pursue a lawsuit. What statute of limitations applies to your product liability claim? In the state of California, product liability claims are subject to a two-year statute of limitations – meaning that the parties affected by defective products only have two years to file their claims. Although the statute of limitations is strict, exceptions could apply. Certain details, such as the age of the affected victim, among many others, could affect the statute. More specifically, certain details could pause the statute of limitations, essentially giving claimants more time to sue. To ensure that claimants do not lose their right to sue, it is essential that they have a thorough understanding of the statute of limitations that applies to their claim. Because of the importance of understanding the applicable statute of limitations, we always recommend that the parties interested in pursuing claims meet with an attorney to discuss the possible statute of limitations that applies to their claims.

Injured by a Defective Product – What Should I Do?

Whether you were injured by the defective folding chairs sold by Rite Aid or any other defective product, it is essential that you take the appropriate actions immediately. Unfortunately, many people fail to take the appropriate action immediately after being harmed by a defective product which results in essentially decreasing the likelihood of reaching a successful claim outcome. Immediately after being harmed by a defective product, it is essential that victim and their families do the following:
  • Stop using the defective product
  • Seek medical attention for all injuries sustained
  • Take photos of any visible injuries
  • Take photos of the defective product, making sure that the defect (the bent metal frame) is clear
  • Contact Rite Aid to report the defective product and the injuries that were sustained
  • Do not accept a refund, a free repair, or a free replacement
  • Do not send the defective product back to the company
  • Do not try to repair the defective product yourself (do not tamper with it whatsoever as the company might try to blame the defect on you)
  • Gather purchase records
  • Gather medical records
  • Gather all other records associated with the losses resulting from the harm suffered (such as lost wages, for example)
  • Contact a defective product attorney
When you follow the recommendations listed above, you are essentially preparing to file your claim – you are gathering important tools necessary to reach a successful outcome. Although it is recommended to follow the steps above, you can still pursue a successful claim even if you miss a few steps. If you would like to learn more about the most important steps that victims of defective products should take to ensure that they preserve their right to sue and reach a successful outcome, do not hesitate to contact the experts at Downtown L.A.
