Homeless Man Fatally Struck by Firetruck Outside Station – Firetruck Accident Attorneys
A man was fatally struck outside a Long Beach fire station in near midnight. The Long Beach Fire Department was responding to a call at approximately 12:30am. As the fire engine was pulling out of the station, it hit a man. The incident occurred right outside the doors of the fire station. Reportedly, personnel provided aid, but the man was pronounced dead at the scene.
The fire station is located on Claremont Avenue and Second Street.
The man was later identified as 62-year-old Michael Shaun Ross. According to the medical examiner, Ross was unhoused. It is unclear what the man was doing outside the station when the incident occurred.
The incident remains under investigation.

Although every incident is different, some of the possible incidents that victims could suffer could include the following:
- Head injuries, including concussions and traumatic brain injuries
- Neck injuries
- Back injuries
- Spinal cord injuries
- Punctured organs
- Crushing injuries
- Fractures
- Lacerations
- Severed limbs
- Scrapes and bruises
- And more
These incidents could lead to temporary or permanent disability and could even be fatal, like in the incident described above.
Can I File a Lawsuit?Yes, if you or a member of your family suffered injuries after being struck by a firetruck, you could have the right to file a lawsuit. First and foremost, it is necessary to establish liability. Who is liable for the incident and the resulting harm? In some cases, firetruck drivers could be liable. Although firetrucks that are responding to emergency calls have to get to their destinations as fast as possible and are allowed to violate certain traffic laws while their sirens and lights are on, they must still exercise due regard for the safety of others, such as pedestrians.
Since the incident discussed above happened right outside the fire station, it is possible that the sirens/lights were not on yet, they exited the station too fast, they were not paying attention to make sure it was safe to exit, or they failed to yield to a pedestrian, etc. In these situations, the firetruck driver – and, ultimately, the fire department – could be found liable and could be sued.
It is important to note that victims could be found liable for their own accidents, which could affect the right to sue and even the recovery that is available. For example, if the victim’s own actions (like suddenly crossing in front of the firetruck, ignoring sirens, not paying attention to surroundings, or even being intoxicated, etc.) contribute to the accident, then the victim can be found to be partly responsible.
Although fire departments may have certain immunities when it comes to these incidents, it is important for victims and their families to understand that they could still have the right to pursue a claim. For more information about your right to file a lawsuit, contact us today.
Can I Recover Compensation?Yes – you could recover compensation. Although every claim is different, you could be eligible to recover compensation for some of the following:
- Medical expenses
- Lost earnings
- Pain and suffering
- Funeral and burial costs
- Punitive damages
- Legal costs
Our lawyers are committed to helping you secure the maximum recovery available for your claim – whether we have to negotiate a settlement or take your claim to trial to reach a verdict. For more information about the compensation that you could receive if your firetruck accident claim is successful, contact the experts here at our law firm as soon as possible.
How Long Do I Have to Sue?All claims are subject to a statute of limitations (or a deadline to sue). When claimants do not file their claims on time, they run the risk of losing their right to sue entirely. In general, injury claims and wrongful death claims are subject to a two-year statute of limitations. However, since claims involving the fire department are government claims, they must be filed within just six months. To ensure that you have a thorough understanding of the total time that you have to sue, contact us today.
