On January 5, 2023, Quality Bicycle Products (QBP) recalled around 8,740 units of their bicycles and handlebars. The recalled handlebars include the Salsa Cowbell, the Salsa Cowchipper, and Whisky No.9 24F, and Whisky No.9 12F carbon handlebars. These handlebars were sold with the Salsa Cutthroat, Warroad, and Warbird bikes, which have also been recalled by the company.
The handlebars are prone to cracking around the brake/shift levers and cause the rider to lose their balance or control of the bike. Crashes and other serious accident are more than likely in these situations, and the manufacturer has advised all consumers to stop using the bikes / handlebars immediately. QBP is offering replacement handlebars of a free installation service at a local bicycle retailer.
If you have suffered an accident due to a recalled product, you may be entitled to personal injury compensation, such as medical bills, lost income, pain and suffering, and property damage. Before you do anything else, please take a moment to contact our office and speak with a defective bicycle accident injury lawyer.
Injuries from a Bicycle with Defective Handlebars
Bicycle accidents often lead to serious injuries, even if you are wearing a helmet and other protective equipment. Possible injuries from defective parts on a bicycle include:
- Broken bones
- Deep cuts
- Soft tissue injuries
- Skull fracture
- Traumatic brain injury
- Dislocated / fractured kneecap
- Broken collarbone
- Hip fracture
- Broken tailbone
- Bruised / ruptured internal organs
- Neck / spinal cord injury
- Dental damage (broken or missing teeth)
Steps to Take after a Bicycle Accident
Even if there is a mass recall on a defective product, you will need evidence to prove that the product in question is responsible for your accident. By taking the steps listed below, you can maximize your chances of succeeding in a compensation claim if you’ve been harmed by a QBP bicycle.
Is There a Class Action Lawsuit for These Cases?
- Immediately take photos of your injuries and the scene of your accident, or ask someone to do it for you if you are seriously injured.
- Get to an emergency room or urgent care facility to receive treatment for your injuries. Make sure to do this right away, or the manufacturer will argue that your injuries were caused by something other than the accident.
- Call the manufacturer to notify them of the accident, but don’t accept any offers for a refund, replacement product, or free repair service, and don’t agree to give a recorded statement.
- Seek legal advice from a product recall lawyer as soon as possible.
Most people associate mass recalls with class actions lawsuits or mass torts. Since the recall by QBP was issued so recently, there is no class action on these cases at the moment. However, a class action claim is more than likely as we are contacted by more victims, so all you have to do right now is contact our office and learn about the legal actions that are available to you. If you decide that filing a claim with other victims is in your best interest, a class action lawyer will help you join or initiate a lawsuit against Quality Bicycle Products.
