They were sold from March 2015 through July 2020, again depending on the piece of furniture. Check with the company for specific details.
The company recommends that customers stop using the furniture and keep it away from children. You can prop it against the wall so that it will not fall or anchor it yourself. The company is offering a full refund. There have been no incidents reported from the defects.
Injuries from Defective Furniture
Chests, dressers, and cabinets are heavy pieces of furniture that can tip over if they are built wrong or if they are not actually anchored or affixed to the wall. They’re usually filled with clothes or other materials that weigh a lot, and some people tend to keep their drawers slightly ajar, leading to higher chances of the furniture tipping over. In houses with children, it can be very dangerous – children often use furniture as props or run around near furniture, and if they are not careful, the furniture can fall on them.
If a piece of furniture tips over and lands on a child, the child can suffer serious injuries. A heavy chest, dresser, or cabinet that has landed on a child can trap him, suffocate him, or lead to intense head injuries, to name a few. Some of the common injuries from tipped over chests include:
Children are more likely to suffer serious injuries because the chests can prevent them from crying out for help or may trap them and cause them to be stuck. If a chest falls on an adult, the damages may be less severe. They could suffer knee injuries, foot damage, ankle trauma, broken toes, and more.
How to Sue Noble House Home Furnishings
If you wish to sue Noble House Home Furnishings for injuries you or your child suffered due to a defective piece of furniture, you will need to show that the company was negligent in some way. Negligent action is the root of all product liability claims, and it can be shown in one of three manners:
The first step you should take if you wish to sue is to pursue medical attention. You should go to the doctor for treatment as quickly as possible, or take your child to the doctor so his injuries can be dealt with. The longer you wait to see a doctor and get treatment, the more likely it is that your injuries will worsen. It will also have a negative impact on the claim. Insurance agents tend to doubt claims that have these long gaps, as it could indicate that they were not seriously hurt or that they were hurt somewhere else from another scenario. Additionally, while at the hospital, do not forget to ask for receipts, doctor’s statements, test results, and an itemized list of what you were billed for. You should cross check this list with what your insurance policy will cover.
Interview eyewitnesses who may have seen the incident happen, like family members or friends who were over. You could also ask other victims if they wish to jin a class action lawsuit against the company to collectively sue for damages.
Take many pictures of the injuries that were sustained, as well as the chest and its location.
Do not throw away the item, return it to the store, try to fix it, hire someone to repair or bring it somewhere to be repaired, or do anything else that could possibly alter its state. The chest is the most important piece of evidence you have, and if you get rid of it or tamper with it, the company can claim that the evidence was marred and that there is no way of telling who was responsible.
You should copy any receipts you have that show that you bought the chest. You could produce bank or credit card statements, emails, paper documents, and more.
It is highly recommended that you reach out to a lawyer who can help you with your product liability claim.
There statute of limitations is the time during which you can file a lawsuit for compensation if you were hurt due to the negligent action of a company. Product liability claims should be filed quickly so that the evidence is kept intact and does not get lost or corrupted.
There are a few scenarios in which the statute of limitations can be extended beyond the 2-year deadline. These scenarios include the following:
Many individuals simply fail to understand when the statute of limitations runs out. They often end up unaware of the time limit and miss out on their chance to sue. Our attorneys will ensure this does not happen with your claim
Earnings from a Product Liability Claim against Noble House Home FurnishingsThe amount of compensation you can earn in a product liability lawsuit against Noble House Home Furnishings will be determined by the degree, severity, and impact of your injuries on your life and career, as well as on your level of responsibility in the incident. If the agent believes that you were mostly responsible and weren’t badly hurt, he likely won’t make a large offer. Our goal is to bring you every penny you deserve from the company, including:
You may owe a lot of money in medical bills and other debts, and the company should be held liable for your losses.
