DeWALT Miter Saws Recall Class Action Lawsuit
On August 4, 2022, DeWALT issued a recall for the DeWALT 12-inch Sliding Compound Miter Saws. According to the recall, number 22-196, the product’s rear safety guard can break or detach resulting in an injury hazard due to projectiles that can struck users and bystanders. In addition, the product presents a laceration hazard to users that could potentially come into contact with the blade. The recall has affected over 1.25 million products.
The recall includes the following models of the DeWALT Miter Saws:
- DWS779
- DWS780
- DHS790
The model number can be found printed on the saw’s nameplate. The affected saws have date codes 2019 04 through 2022 04. The DWS779 and DWS780 models of the miter saws have the date code marked on the black plastic motor end cap that is adjacent to the name plate. The DHS790 model has the date code marked on the outside of the plastic yellow housing that is adjacent to the batteries.
The defective miter saws were sold from April 2019 to May 2022 for prices ranging from $600 to $820 at a number of stores, including Lowe’s, The Home Depot, other hardware stores, and online at Amazon.com, Lowes.com, and other online retailers.
So far, the company has received at least 571 reports of the rear safety guard breaking or detaching; this number includes 9 reports of lacerations.
The company is urging all affected consumers to stop using the saws and contact them for information on receiving a free repair kit, or to take the product to a service center for a free repair. However, injured consumers should not follow those recommendations – instead it is important that they seek legal help. Based on the details surrounding the incident and the harm that you suffered, you could be entitled to monetary compensation, but following any of the recommendations made by the company could actually result in losing the right to sue.
