Amtrak Train Derailment Leaves Passengers Injured

Amtrak Train Derailment Leaves Passengers Injured attorney lawyer lawsuit

Many people were injured after an Amtrak train partially derailed in the late morning of Wednesday, June 28, 2023. The Amtrak derailment occurred at approximately 11:30am after the train struck a water truck in the Moorpark area at a railroad crossing near Los Angeles Avenue. The train had departed from Union Station and was headed towards the state of Washington.

According to the Ventura County Fire Department, the Amtrak train was carrying a total of 199 people – 13 crewmembers and 186 passengers. The incident with the public works truck, which was owed by the Ventura County Public Works Agency, caused three of the seven train cars to derail. Although these train cars came off the tracks, they remained upright (only slightly tilted to one side).

According to reports, 16 people traveling in the train were transported to local hospitals with different injuries, most of which were minor. The driver of the water truck was transported to a local trauma center; he suffered critical injuries, although they were not life-threatening. The impact was so severe that the truck ended up in two pieces and ended up hundreds of feet from where the impact occurred.

The cause of the crash is still under investigation.

Unfortunately, train incidents are very common. Vehicles on the tracks for whatever reason, whether they are stalled or abandoned, can result in an impact that can ultimately lead to the train derailing. Train derailment incidents can typically cause devastating injuries to everyone involved. If you or a loved one suffered harm in the Amtrak incident above or another train derailment incident, it is important that you seek legal assistance as soon as possible.

Possible Injuries Resulting from Train Derailment Incidents

Train derailment incidents can cause significant injuries to all people involved. Some of these injuries can include the following:

  • Head injuries and traumatic brain injuries
  • Broken nose
  • Broken teeth
  • Eye injuries
  • Neck injuries
  • Back injuries
  • Spinal cord injuries
  • Hip injuries
  • Pelvic injuries
  • Knee injuries
  • Fractures (including broken ribs)
  • Dislocations
  • Crushing injuries
  • Impaling injuries
  • Severed limbs
  • Burns
  • Scrapes and bruises
  • Lacerations

With train crashes, the train comes to a sudden stop and the train cars can derail or fall off the tracks. In most cases, the train cars end up completely on their sides; because of this passengers can be thrown around in the train cars and suffer significant injuries.

When it comes to the drivers and passengers of the vehicles that are on the tracks, injuries are often critical and can be fatal. When the incident involves a pedestrian, the train might not derail, but the pedestrian likely suffers fatal injuries.

No matter the injuries that you or a member of your family suffered in an Amtrak train accident, you could have the right to sue. Contact us today for more information about your legal options.

Can I Sue for Injuries after an Amtrak Train Accident?

Yes – you could have the right to file a lawsuit if you or a member of your family suffered harm in a train accident. Amtrak is considered a common carrier; therefore, Amtrak has to exercise the highest degree of care to maintain the safety of their passengers. When Amtrak or another common carrier fails to keep their passengers safe, then they could be found negligent and be held liable – and could be sued.

For more information about your right to sue Amtrak or any other passenger train company for the harm that you or a member of your family suffered in a train accident, contact us today.

Amtrak Insurance Policy

Under U.S. Code § 28103, Amtrak is required to maintain liability coverage for claims either through insurance or self-insurance of a minimum of $200,000,000 per incident. This means that Amtrak has one of the highest insurance coverages around. If you or a loved one suffered harm in an incident on an Amtrak, you could sue and recover a payout from this insurance policy. If you are unsure of whether you could file a claim under this insurance policy and recover the settlement that you are owed for your injuries, contact us today.
