Man Arrested after Fatal Shooting at Amazon Fresh Store Parking Lot

Man Arrested after Fatal Shooting at Amazon Fresh Store Parking Lot lawyer attorney sue lawsuit

An 80-year-old man was arrested after a fatal shooting on Tuesday, May 30, 2023 outside an Amazon Fresh store in Westchester, California. The shooting happened in the parking lot of the store, which is located on the 6800 block of La Cienega Boulevard near Centinela Avenue.

According to witnesses, there was a confrontation between the 80-year-old man and a 30-year-old man. The 30-year-old man allegedly drove his white pickup truck erratically into the parking lot, came to a screeching stop, and started arguing with an older lady that pulled into the parking lot shortly after (the older lady is a neighbor lived in the apartments nearby). A few moments later, the 80-year-old man came out of his home in a robe holding a gun. One witness claims that he likely came out to protect the woman, as they were neighbors. The 30-year-old man began yelling at the other man, calling him racial slurs, and yelling at him. This is when the shooting occurred.

The authorities took the 80-year-old into custody and rendered aid to the 30-year-old man that had been shot, although he was ultimately pronounced dead at the scene. Neither the suspect or the deceased victim have been identified, and the incident remains under investigation.

Unfortunately, these incidents are far too common. In this situation, it appears like it started with a road rage incident that escalated after the neighbor came out to the parking lot armed and trying to defend his neighbor.

These incidents bring up many questions. Some of these questions include the following:

  • Who is liable for the death resulting from the shooting?
  • Can the property owner be held accountable?
  • Is Amazon Fresh liable for the incident that happened on the parking lot?

Below, we will address some of these questions.

Who is Liable for Deaths Resulting from Shootings?

In general, the shooter is at-fault for any injuries or death resulting from a shooting; after all, it is the actions of the shooter that directly harmed the victim. Of course, depending on the situation, other parties or entities could be liable.

Are Property Owners Liable for Shooting Injuries on their Premises?

Under the concept of premise liability, property owners have a duty to keep their entire premises safe for everyone on their property. This extends to parking lots. So, what does this mean? Property owners must keep their entire premises safe. Therefore, they must routinely inspect the premises to be able to identify and address any hazards or dangerous conditions. Most hazards include wet floors, broken concrete, poorly installed shelves, etc.; however, there are hazards presented by other people on the property – which can usually only be addressed by increasing security.

Can Amazon Fresh Store be Liable for the Incident that Happened at their Parking Lot?

Yes – the property owner, in this case Amazon Fresh, could be liable for any harm resulting from an incident in their parking lot. As mentioned above, property owners are responsible for keeping their entire premises – including their parking lots – safe. They must have appropriate security and security cameras, for instance. If there was security at the store parking lot, then store security could have responded and quickly deescalated the situation (even just by asking any of the people involved to leave the premises) or by contacting the authorities for further actions, for example.

Without a doubt, the property owner is likely to argue that they could not have known that an incident of that magnitude could occur and that they cannot be held liable. Still, it is important to seek legal advice as soon as possible.

Can I Recover Compensation for Wrongful Death?

Yes – if a member of your family was killed in a store parking lot, you could potentially be eligible to receive compensation for the wrongful death of a loved one. Depending on the details surrounding the claim, claimants could be eligible to recover compensation for medical expenses, lost earnings, pain and suffering, loss of consortium, funeral/burial costs, punitive damages, and legal fees, for instance. For more information about the compensation that you could be eligible to receive, contact the experts here at our law firm as soon as possible.
