Two people were killed and one other was hospitalized on Tuesday 10/08/24 after a crash that occurred on a road notorious for speeding and violent crashes in the Porter Ranch neighborhood. The collision was reported at approximately 11:15pm.

According to authorities, a gray BMW traveling northbound on Tampa Avenue struck a white Toyota that was making a left turn onto Atlanta Avenue, south of Chatsworth Street. Neighbors that heard the collision rushed to help the victims; they found two people trapped inside the white Toyota. These two individuals were extracted with the jaws of life, but unfortunately, they were pronounced dead at the scene. The victims were two men in their 50s. The driver of the BMW was identified as a 20-year-old man; he was taken to a local hospital with non-life-threatening injuries.

According to investigators, they do not believe drugs or alcohol were factors in the incident; rather, they believe the incident was caused by misjudgment.

The Road is Known for Crashes – the incident occurred in a stretch of the road that is known for violent crashes. These incidents often occur due to street racing or speeding. According to the police department, there are no stop signs or lights, “so, when someone makes a lefthand turn they’re thinking it’s going to be safe” but it is really not.

Unfortunately, there are many Los Angeles roads that are known for car crashes. These roads usually are poorly lit, uncontrolled, or many have other safety issues present. If you or a loved one suffered harm in an accident resulting from unsafe road conditions, it is important that you seek legal assistance as soon as possible. Based on the details surrounding the incident and the resulting harm, you could have the right to file a lawsuit.

Unsafe Road Conditions Can Lead to Incidents

Although most accidents are caused by the recklessness of drivers on the road, whether it’s speeding, making unsafe turns, or driving under the influence, the truth is that many roads have unsafe conditions that can ultimately contribute to incidents.

Some example of the unsafe road conditions that could lead to incidents include the following:

  • Poorly lit roads (or no lighting at all)
  • Blind intersections
  • Uncontrolled intersections
  • No stop signs, yield signs, or caution signs
  • No posted speed limit signs
  • No speed limit enforcement
  • Defective traffic signals (not properly timed/synched, not functional, etc.)
Who is Liable for Incidents Caused by Defective Road Conditions?

In general, liability for car accidents falls onto the party or entity responsible for causing the accident; this is usually a reckless driver or even an employer (since employers can be liable for the negligence of their employees). However, road work agencies could also be liable – as road work agencies are responsible for road maintenance and ensuring that road conditions remain safe. When any hazards or unsafe conditions arise, it is important for these agencies to immediately address the situation to prevent any incidents. In general, these road work agencies are government entities, although some may be private companies that have contracts with the city or county.

If you or a loved one were involved in an incident that can be attributed to unsafe road conditions, you could have the right to sue. Please do not hesitate to reach out to our law firm to explore the legal options available to you and your family.

Can I Recover Compensation?

Yes – you could be eligible to receive compensation for the harm that you or a loved one suffered in a car accident at an unsafe road known for crashes and collisions. Although every situation is different, you could be entitled to receive compensation for some of the following:

  • Medical costs
  • Lost earnings
  • Pain and suffering
  • Property damage
  • Funeral and burial costs
  • Loss of consortium
  • Punitive damages
  • Legal costs

How Long Do I Have to File My Claim?

In general, car accident claims are subject to a two-year statute of limitations. This applies to claims involving normal vehicles or even work trucks, when the employer is a private company. However, when a government entity is involved, such as a road work agency, for example, claims are subject to a shorter six-month statute of limitations. Depending on the response (or lack of response from the government entity), claimants will have either six months or two years to file lawsuits.

Because failing to file on time could result in losing the right to sue entirely, it is important that you know exactly how long you have to file your claim. If you are unsure of the deadline that applies to your claim or have any questions surrounding the statute of limitations, contact us today.
