Breaking News: a Southern California high school coach arrested after being accused of having sex with a teenage girl

A former SoCal high school coach was arrested for allegedly having sex with a teenage girl. The former coach has been identified as 24-year-old Jonathan Xavier Cabral, of Fullerton, according to the Laguna Beach Police Department. Cabral worked as a walk-on assistant track coach at Foothill High School located at 19251 Dodge Ave. in North Tustin.

On July 27, 2024, the authorities were alerted of Cabral reportedly having sexual relations with a 14-year-old teenager. According to police, Cabral was already being investigated. Reportedly, Cabral met the teen online and met up with her for “sex and other lewd and lascivious acts.” According to investigators, the incidents occurred in Laguna Beach, California.

Cabral was arrested on August 14; he is facing multiple charges, including the following:

  • Statutory rape
  • Meeting with a minor for lewd purposes
  • Possession of child pornography
  • And more

Cabral was released on $100,000 bail. Detectives believe that there may be additional victims; they are urging victims or anyone with any information to come forward.

Child Sexual Abuse at the Hands of Coaches

Unfortunately, child sex abuse is very common at the hands of coaches that work in schools. Coaches with ill intent have easy access to students. They gain their trust, often befriending them, and abuse them. When abuse happens at schools, the school could be liable. Of course, abuse can also occur outside of schools and minors not affiliated with the school can also be abused.

Examples of Harm Resulting from Child Sex Abuse

Although every situation is different, victims of child sex abuse at the hands of sports coaches could include the following:

  • Unwanted pregnancy
  • Sexually transmitted infections
  • Injuries to genitals
  • Injuries to reproductive organs
  • Other physical injuries, such as fractures, lacerations, scrapes, and bruises
  • Mental and emotional injuries, such as post-traumatic stress, depression, anxiety, panic disorder, fear, increased risk of self-harm, etc.
Liability for Child Sex Abuse

When a coach abuses one of their athletes, the entity that employs them could be liable. Depending on the situation, this may be a school district or even a sports agency could be liable. Liability is generally based on negligent hiring and supervision, including failing to conduct background checks, failing to properly train employees, and failing to properly supervise interaction between coaches and minors. Of course, these entities could also be liable for failing to report abuse, ignoring abuse, or simply letting it happen. In cases in which the victim was not a student in the district or an athlete in the sports team, these entities may not be liable – although these entities could be liable for any additional abuse that occurs after initial accusations.

Can I File a Lawsuit?

Yes – you could have the right to file a civil lawsuit for sexual abuse suffered at the hands of Coach Jonathan Xavier Cabral or any other coach. For more information about your right to file a civil lawsuit, please do not hesitate to reach out to our expert legal team as soon as possible. Our lawyers are ready to guide you every step of the way.

The Statute of Limitations for Child Sexual Abuse by Coaches

All claims are subject to a statute of limitations – or a deadline to sue. When claimants do not file their claims on time, claimants could lose their right to file a lawsuit entirely. So, how long do you have to file a lawsuit? Under California law, victims of child sex abuse have until the age of forty – or twenty-two years after reaching eighteen-years-old to file a lawsuit. There is also a five-year discovery rule, which allows victims to sue within five years of discovering the harm resulting from the abuse (this is especially important considering that victims of child sex abuse often have suppressed memories due to the trauma). To ensure that you have a thorough understanding of the deadline that applies to your claim, contact us today.
