Washington Shoe Company Rain Boots Recall – Product Liability Lawyer
Washington Shoe Company issued a recall for its Western Chief toddler light-up rain boots on December 9th, 2020. 77,o00 pairs of shoes were involved in the recall due to the rivets present in the boots being likely to detach. This can cause children to choke on the loose materials.
The boots came in three varieties: “Abstract Camo,” “Alia Silver,” and “Sweetheart Navy.” The Light-Up Rain Boots came in numerous sizes, from 5-12. The rivets are silver in color and are on the outside of the boot. The model numbers are, respectively, T24121725P, T24121728P, and T24121729P. They were manufactured in Washington and sold out of Target at various stores across the country from May 2020 through October 2020 for about $25. They could also be purchased online.
There have been 115 reports of the rivets and handles on the boots detaching. 2 of the incidents involved children nearly swallowing the rivets.
Choking Hazards for ChildrenChildren generally do not know the dangers associated with small objects. They often place things in their mouth and chew on them or swallow them, and they have to be watched closely or they can swallow these items and choke. They may also suffer internal problems with their intestines or throat damages depending on what they swallow.

Product liability lawsuits are based on the negligent action of a company. Primary may have been negligent in creating the shoes, or the factory could have made an error. There are three ways to prove liability, which are:
- There was a design error present with the boots
- There was a manufacturing error that occurred when the boots were being created
- There were no hazard or warning symbols or signs on the boots or on the box they came in
Washington Shoe Company likely did not design the rain boots with the intent of the handles to break off. They likely made an error in measuring how strong the handles would be. It is also possible that the company used the wrong materials.
The steps to take to file a product liability claim against Washington Shoe Company can be found here:
- Go to the hospital to get treatment for your child’s injuries
- Do not take too long to take your child to the doctor, as your claim may suffer; a delay can also cause the insurance agent to doubt the validity of your case
- Hold on to medical receipts, doctor’s statements, test results, prescriptions, and more
- Take pictures of any physical injuries, if they occurred
- Take photos of the shoes to show that they were not tampered with
- Get copies of receipts, bank statements, credit card statements, or anything else showing that you bought the rain boots
- Ask eyewitnesses for their statements and testimonies regarding the incident, or anyone who can testify that they saw the rivets detach
- Do not throw away the boots, take them to a repair shop, or try to fix them
- Do not return the rain boots or seek a refund from the company
Upon gathering your necessary evidence, it is recommended that you reach out to a product liability lawyer in Los Angeles. If you do not have experience in product liability claims, you will not know how to proceed. You will not be able to receive fair compensation for your damages at all. It is a better choice to let a legal representative handle your claim while you focus on helping your child recover.
Compensation from a Defective Product Lawsuit against Washington Shoe CompanyA product liability claim against Washington Shoe Company can result in a fair amount of compensation. You may be able to receive total coverage for a few areas of losses. We will strive to bring you every penny you deserve, but the insurance agent will try to pay as little as possible. Our attorneys are expert negotiators, though, and we will see to it that you are awarded the following:
- Medical expenses form the past and future for any treatments and prescriptions you received
- Lost income if you were unable to go to work because of medical treatment, injury, recovery time, and more
- Property damage if your personal belongings and possessions were broken or lost
- Pain and suffering damages for emotional trauma and anxiety
You should not have to pay for these damages if the company was the cause of the defect. We believe that Washington Shoe Company should be held fully liable and should pay for every expense you racked up and for all the damages that occurred to your child.
The statute of limitations to file a claim against Washington Shoe Company for injuries from a defective pair of shoes is 2 years from the date of the injury. If you don’t sue within that time period, you won’t be able to collect compensation. You should act quickly so that all your evidence is preserved and there is no chance of it being forgotten, lost, rejected, or corrupted.
It is possible for the statute of limitations to be extended past the 2-year deadline. This can happen in the following scenarios:
- Underage victims can wait until they turn 18 years old to sue
- Victims left incapacitated after the incident can wait until they return to health
- Cases where the defendant left the state can have the statute put on hold until he returns
Victims often do not know the statute of limitations or how long they have left on their cases. If you come to our firm, we will be sure to file your lawsuit on time and ensure that you miss no important dates.
