Hysterectomies are one of the most common surgical procedures performed on females in the United States with 500,000 thousands performed every year. The vast majority of hysterectomies are performed successfully with little or no post operation adverse medical complications. However in numerous instances medical practitioners failed to perform proper hysterectomies resulting in severe medical complications and fatalities. Victims of laparoscopic hysterectomy surgical malpractice are entitled to compensation from all at fault parties which may include the practicing surgeon, hospital staff and administrators, and manufacturers of defective laparoscopic medical devices including daVinci medical systems. The DaVinci robot is a highly complex remote controlled medical system. In 2000 the Food and Drug administration approved the daVinci Laparoscopic surgical system for general use in minimally evasive medical procedures. Since then the use of the daVinci method has been increasingly used in hysterectomy procedures across the country. It is estimated that between 40% to 50% of all hysterectomy procedures in the United States are performed using the Laparoscopic method. In many instances Laparoscopic medical devices fail or malfunction resulting in severe medical complications. Generally there are three distinct causes of action possible for victims of defective products in a product liability claim (1) Defect in the original design of the medical device (2) Defect in the manufacturing process which resulted in the final product being significantly different and as a result more dangerous than it intended design (3) Labeling defect, or a failure to properly warn users of the medical system of the danger associated with its use.
