Statute of Limitations on Medical Malpractice Claims

In California, there is a statute of limitations of 1 year or 3 years to file a claim for medical malpractice. If you discovered the injuries to your foot upon leaving the podiatrist at any point up to 1 year after the procedure, you must file a claim no later than 1 year later. It is important that you take action as quickly as possible so that all your evidence is sufficiently preserved.

However, if more than 1 year passed with no knowledge of the damages, you will then have 3 years from the date of the injuries themselves to take action.

If the 3 year deadline then passes, you will simply not be able to file a medical malpractice claim.
