Falling Tree Accident, Jury Awards 7.7 Million To Injured Man
A San Diego jury awarded a record setting judgment to a man whose legs were crushed after a 60 foot tree collapsed causing serious injuries. The courts determined that the city was responsible for the negligent care of the tree that caused the injury. Toppling trees are common, but generally cause property damage.
When the department responsible for maintaining these services fails to properly inspect them, they will be liable. In this unfortunate case the city of San Diego failed to properly maintain the landscaping, therefore causing the tree to fall over and cause damage.
