Man Dies a Hero – Rescues Family From Mobile Home Fire in Highland

In March 2019, a 25-year-old man – Albert Madrid – died after rushing into a burning mobile home in Highland to help rescue a family from a fire. Madrid did not make it out of the flaming mobile home alive. The fire occurred at approximately 12:15 a.m. in a trailer park at the 72000 block of Sterling Avenue. an Dies a Hero - Rescues Family From Mobile Home Fire in HighlandWhen the fire department arrived at the scene, the residents of the mobile home had already been rescued by Madrid; they suffered mild to moderate injuries. However, Madrid was still in the mobile home, which was engulfed in flames. After extinguishing the fire, firefighters found Madrid’s body among the debris. He was pronounced dead at approximately 12:49 a.m. His father made the following statement: “[Albert] noticed a trailer was on fire as he and his girlfriend [pulled] into the trailer park. Without even thinking about it, he jumped off his car and ran into the burning trailer to help two little girls who were still inside. He helped the little girls get our but he wasn’t able to escape the burning trailer himself.” The Madrid family wants to remember Albert as the hero he was; his selflessness saved multiple people.

The Cause of the Fire

Although information surrounding the cause of the fire was unclear for a very long time, information points to the pipes under the mobile home park were damaged. Residents of the mobile home park couldn’t have possibly known that there were any issues with the gas pipes under the park. Could the owner of the mobile home park have known that the gas pipes under the park were damaged? Could the gas company have known that the gas pipes were damaged? Gas lines can become damaged for a number of reasons. Gas lines could become damage simply due to normal deterioration, in earthquakes, or in digging for construction, for example. Although damaged gas lines are not always obvious, parties must do everything within their reach to address the damaged gas lines as soon as the possibility. The cause of a fire or explosion associated with damaged gas lines could be related to the property owner’s negligence or even the gas company’s negligence, depending on the specific circumstances of the incident. Understanding the Dangers of Fire and Related Injuries

Fires can cause significant injuries to all parties involved. Without a doubt, the most common type of injuries consists of burns. The parties involved in fires could suffer burns varying in degrees – the most severe charring bone. In addition to burns, the parties involved in fires could suffer other harm. Smoke inhalation can cause many complications and could even lead to death. Smoke is quick to fill a burning structure; the parties inside could inhale smoke and gases, which could inflame the lungs/airway and essentially block oxygen. If a victim survives smoke inhalation, it is possible that he or she will be left with respiratory issues – it is even possible to sustain brain damage due to the lack of oxygen to the brain. Fires could also cause structural damage, which could result in collapsing roofs and walls, for instance; this could result in victims becoming trapped under debris and suffering additional harm.

The Right to Sue

Depending on the specific details of the incident that harmed you or a member of your family, you might have grounds to pursue a claim. For example, if a property owner was aware with issues with the gas lines but dialed to take any immediate action, the property owner could be held liable. Likewise, if the gas company was informed of the possible issue with the gas lines and failed to get to the scene and investigate, for instance, the gas company could be held liable. In addition, any construction companies that started digging without the proper authorizations, leading to damaging gas pipes, could result in construction companies being held liable. Your right to sue is based on negligence – a party owed you and your family a duty of care that was breached, directly leading to the fire and the harm that you suffered. If you can prove that the negligent actions of a party directly caused the harm that you suffered, you will likely have the right to file a claim.

  • Medical expenses
  • Lost wages
  • Pain and suffering

What is the Applicable Statute of Limitations?

All claims are subject to statutes of limitations (or deadlines) that determine the specific length of time that claimants have to sue. When victims fail to file their claims within the appropriate length of time, they will lose their right to sue. In California, claimants generally have two years to pursue an injury or wrongful death claim; however, exceptions could apply and result in changes to the applicable statute of limitations. If you would like to learn more about the specific statute of limitations that applies to your claim (to prevent losing the right to sue), it is essential that you seek legal assistance immediately – a lawyer will be able to give you all the information that you need regarding the time that you have to sue.
