Above Ground Pools Recall Class Action Lawsuit
Bestway, Intex, and Polygroup have all issued a recall for many of their above-ground pools, specifically 48 inches and taller above-ground pools with compression straps running on the outside and over the vertical support legs. According to the recall, number 25-393, the compression straps that surrounds the outside of the pool legs may create a foothold, which can allow a child to access the pool and represents a drowning risk.
The recall affects about 5 million pools. According to the recall, children can gain access to affected pools even when the ladder is removed.
It is believed that 9 children between the ages of 22 months and 3 years old have drowned after accessing the pools via the footholds. These incidents occurred in many states, including California, Texas, Michigan, Florida, Wisconsin, and Missouri between 2007 and 2022. There are also three other incidents in 2011 and 2012 where children were able to access the pools using the compression strap.
Affected consumers are being urged to immediately contact Bestway, Intex, or Polygroup to receive a free repair kit (a rope that attaches to each of the vertical support poles and ground level and wraps around the pool, maintaining structural integrity of the pool after the compression strap is cut and removed).
The affected pools include the following:
- Bestway and Colman Models (sold 2008 to 2024) – Power Steel, Steel Pro, and Coleman Power Steel
- Intex Models (sold 2002 to 2012) – Metal Frame Pools and Ultra Frame Pools
- Intex Models (sold 2024 to 2025 exclusively at Intexcorp.com and Walmart) – Prism Frame Pool and Ultra XTR Frame Pool
- Polygroup Models (sold 2006 to 2025) – Summer Waves, Summer Escapes, Funsicle, Sand n Sun, and Blue Wave
The pools have been sold since 2002 at stores nationwide, including Sears, Target, Walmart, Kmart, Lowe’s, Toys “R” Us, Sans Club, The Home Depot, Big Lots, BJ’s, and Costco among others. They were also available for purchase online via Amazon.com, Wayfair.com, as well as Summer Waves, Funsicle, Intex, and Bestway USA official websites.
The recalled pools were manufactured in China. They were sold for prices ranging from $400 to over $1000 depending on the size/model of the pool and additional accessories offered.
The Injuries that Can Occur
As mentioned above, the defective pools have caused multiple drowning incidents. There are also separate incidents in which children accessed pools but did not drown. The truth is that even near drowning incidents can result in significant harm.
