Medline Bed Assist Bar Adult Bed Rails Recall Class Action Lawsuit
On May 30, 2024, Medline issued a recall for their Bed Assist Bar adult bed rails. According to the recall, number 24-248, users can become entrapped within the bed rail or between the rail and the mattress when the bed rails are attached to beds; this poses an entrapment risk and the risk of asphyxiation. The recall affects two models of the bed rails, bed rails with model numbers MDS6800BA and MDS6800BAH (the products are the same except one was sold in sets of three).
The affected bed rails are made out of black metal tubing and have a rounded black foam rubber grip handle as well as a fabric pouch. “Medline” and the model number can be found printed on a label on the bed rail’s support frame. The company sold approximately 1.5 million units of the defective bed rails from July 2009 to March 2024; the products were sold for prices ranging from $32 and $64. They were available for purchase online via Medline.com, athome.medline.com, Amazon.com, Walmart.com, CVS.com, Walgreens.com, and online medical supply stores (including Magic Medical and Cascade Healthcare Solutions).
Reportedly, there have been two entrapment deaths associated with the Medline bed rails, one in July 2019 and another in November 2023; victims include a 76-year-old woman at a nursing facility in Iowa and an 87-year-old woman at a residential care facility in South Carolina.
The company is urging all affected consumers to immediately stop using the recalled bed rails and contact them for a refund.
If a member of your family died due to asphyxiation after becoming entrapped, it is important that you do not agree to a refund. Rather, you should seek legal assistance as soon as possible to learn more about your right to sue and receive compensation. Bed rails are commonly used with the elderly and others who are physically frail. Bed rails are supposed to prevent individuals from falling off the bed and onto the floor and suffering injuries, like broken bones, broken hips, and bruising, for example. Bed rails can also help these individuals be independent and get into and out of bed on their own (stabilizing themselves with the rail).
Entrapment is very serious. Victims may not have the physical strength to free themselves if they become entrapped. Entrapment can lead to asphyxiation, which can lead to unconsciousness and can ultimately be fatal. If caught early enough, victims may regain consciousness, although the oxygen deprivation may result in brain damage. Other possible injuries can include crushing injuries, lacerations, broken bones, lacerations, etc.
What to do If a Loved One Died Due to a Defective Bed RailYou might be wondering what steps to take if a member of your family died due to asphyxiation. Consider some of the following recommendations:
- Take photos of the scene of the accident
- Take photos of the defective product
- Seek medical care immediately (if the incident was fatal, ensure that the cause of death is confirmed)
- If available, gather any video footage that captured the incident
- Seek legal assistance with a recall lawyer as soon as possible
Class action claims and mass torts are very common when it comes to defective products as countless consumers are likely to be harmed in the same way. These claims allow affected consumers to come together to hold the negligent product manufacturer accountable for all resulting harm. Is there a class action lawsuit? Since there have only been two reported deaths associated with the bed rails so far, it is unlikely that there is already a class action. Can I file a class action lawsuit? Yes, your case could actually be one of the first to be considered for the class action. If you are interested in participating in a class action lawsuit against Medline, contact us today.
