Possible Injuries Suffered during PE at Schools

During physical education classes at elementary schools, middle schools, and high schools, students are required to complete physical education classes. In elementary schools, P.E. classes might be required just once or twice a week. In middle schools and high schools, P.E. is part of the regular schedule and consists of a class period that students attend every day (or every other day depending on the school).

P.E. classes look different from school to school. The exercises that students may have to complete may include jumping jacks, push-ups, curl-ups, pull-ups, sit-ups, squats, walking, running, and sports (such as football, baseball, basketball, volleyball, etc.

Students may suffer from fatigue and exhaustion as a result of this physical activity. This could cause students to faint and momentarily lose consciousness. Some students may suffer cardiac arrest, heart attacks, respiratory distress, etc. In addition, students may suffer head injuries, brain injuries, neck injuries, back injuries, spinal cord injuries, fractures, lacerations, crushing injuries, and more. This can be associated with the use of exercise equipment or even falls during regular exercise.

No matter the specific injuries that your child suffered during PE at school, it is important that you seek legal assistance as soon as possible.

Fatigue and Exhaustion can be Fatal

Unfortunately, fatigue during PE classes in school can lead to exhaustion that can cause heart attack and loss of consciousness. Heat exhaustion can also occur, which could lead to heat stroke. If your child died as a result of being pushed too hard by a coach or a PE teacher, you may have the right to sue the school district.

School District Liability for PE Injuries and Deaths

Are schools and school districts liable for the harm that students suffer during p.e. classes? Yes – schools/districts could be liable. In general, liability for these incidents is based on the duty of care that districts have towards students. That is, the district has a duty to ensure that their students are safe during school. Schools must have appropriate policies in place, such as allowing students to rest between exercises, moving exercises indoors when the temperature out is too high, or skipping exercises on peak summer days, for example. PE teachers, coaches, and assistants must also have the appropriate training to be able to identify student fatigue/exhaustion and address it before they worsen. In other words, staff must allow rest breaks and water breaks. When issues arise, staff must act quickly and – if necessary – get students prompt medical care.

If a P.E. teacher or coach is pushing a student too hard during exercise/training, the school district could be held responsible for any resulting harm.

Can I Sue if My Child was Pushed too Hard During P.E. at School?

Yes, you can sue. If your child suffered any injuries – or died as a result of complications caused by fatigue or exhaustion – you could have the right to sue the school district. How Long Do I Have to Sue?

Under California law, wrongful death claims are subject to a two-year statute of limitations. This means that claimants only have two years to file their claims. When claimants fail to file their claims on time, they run the risk of losing their right to sue entirely, that is why it is so important to understand the deadline that applies and file claims on time. What about claims involving schools and school districts? Claims against schools/districts are considered government claims, so they are subject to a much shorter statute of limitations. In California, government claims are subject to a six-month statute of limitations.

We understand how confusing it can be to try to figure out the time that you have to file your claim. To avoid further confusion, we urge you to seek legal assistance as soon as possible. Our lawyers are more than ready to evaluate your claim and help you file your claim on time.
