Boar’s Head, based in Sarasota, Florida made an announcement on September 13, 2024. They are reportedly closing the Jarratt plant and discontinuing production of liverwurst. This comes after inspections at the plant found a number of concerning problems, including mold, dripping water, meat and fat residues on walls/floors, insects, and old equipment, for example.
The plant has not been operational since late July since the listeria contamination was first announced.
Although the closure of the plant definitely provides peace of mind for the community, the outbreak is a reminder that the unsanitary conditions at the plants that process deli meats can quickly lead to dangerous bacterial outbreaks.
A Brief Summary of the Boar’s Head RecallBoar’s Head initially recalled 100 tons of their deli products after at least 2 individuals died and 34 others were hospitalized in 13 states. In late July, Boar’s Head expanded the recall to include all of the products produced in the facility – this totaled 7 million pounds of deli meat.
Do I have the Right to File a Lawsuit for Listeria Infection Resulting from the Boar’s Head Outbreak?Yes, you could be eligible to file a lawsuit. Whether you suffered an infection or a member of your family died as a result of an infection, you could have the right to file a lawsuit. This is based on Boar’s Head responsibility to ensure that their food products are always safe for consumption. These food production companies have the duty to ensure that their facilities, equipment, practices, etc. meet all safety regulations/standards and that their products are free of contaminants – like listeria.
For example, these companies have the responsibility to routinely clean and sanitize their equipment, properly train their employees, and subject their products to inspections and testing to identify (and of course) address any contaminants present before the products are made available for purchase. When food manufacturers fail to keep their deli meats or any other food products free of listeria bacteria or other contaminants, manufacturers can be liable for all damages/harm resulting from the contaminated food. This means that Boar’s Head could be sued.
In addition to individual lawsuits, it is possible for affected individuals to come together to pursue class action claims or even mass torts claims.
