Are Property Owners Liable for Stabbing Incidents at Bars?

This is a very important question. Ultimately, property owners can be liable for stabbing incidents or other intentional acts that occur on their premises. In general, property owners have a duty to ensure that their premises remain free of any hazards or dangerous conditions that could lead to incidents and harm to guests; this also applies to dangerous conditions presented by other people on their premises (including staff, other guests, homeless individuals, etc.). Further, if the property owner knew or should have known of the danger but failed to take any action, then the property owner could be held liable for resulting harm.

Normally, property owners are not held liable for random acts of violence or isolated incidents. So, if this stabbing incident was the first of its kind, then the property owner may not be liable. However, if the premises has been associated with similar incidents, including physical altercations, assault and battery, attacks with weapons, etc., then the property owner could potentially be held liable. This liability can be based on the failure to have appropriate security present, the failure to have surveillance cameras, the failure to turn away guests who are already intoxicated, the failure to stop serving intoxicated guests, etc.

If a property owner is found liable, they can be sued by victims and their families.
