Nissan Recalls Nearly 400,000 Vehicles Due to Fire Risk
On November 15, 2019, there was news that Nissan will be recalling nearly 400,000 vehicles throughout the U.S. due to a defect with braking systems, which could ultimately result in the vehicles catching fire. The company is urging all consumers that own any of the vehicles involved in the recall to park their vehicles outdoors away from any structures if the antilock brake system warning light comes on (for more than ten seconds).
So, what is going on with the vehicles? The braking system is defective. More specifically, a pump seal can wear down, causing brake fluid to leak. According to Nissan, if the antilock brake system warning “is ignored … the brake fluid leak may potentially create an electrical short in the actuator circuit, which in rare instances, may lead to a fire.”
What vehicles are affected by the recall? At least four U.S. models have been affected by the recall, including the following:
- Nissan Murano SUV (2015 to 2018)
- Nissan Maxima sedans (2016 to 2018)
- Nissan Pathfinder SUV (2017 to 2019)
- Infiniti QX60 (2017 to 2019)

It is unclear whether the defect with the brake system has resulted in any fires or injuries; however, there are plenty complaints (although unconfirmed) on an online board on the National Highway Traffic Safety Administration’s site. Many of these complaints claim that vehicles ignited into flames. Although many people have not been severely affected by the recall (other than the inconvenience of having to take their vehicles in for repair), some have seen the real issues associated with the defective vehicles. Specifically, the defect has resulted in many vehicles igniting. Without a doubt, this issue could result in significant property damage; however, the issue could also lead to injuries. If you suffered any sort of harm as a direct result of the defective vehicles, you might have grounds to take legal action. Specifically, you might have grounds to file a product liability claim against Nissan. If you would like to learn more about your right to pursue a claim for the harm that you suffered associated with the defect mentioned above, do not hesitate to seek legal assistance with the experts at our law firm at your earliest convenience. A vehicle suddenly igniting, without a doubt, could result in significant damage. The likelihood of property damage is prominent – the vehicle could be a total loss and certain structures in your home (near which the vehicle was parked when it ignited), like garages, for example, could be significantly damaged. Besides property damage, the defective vehicle could also contribute to injuries. Some of the injuries that unsuspecting victims could suffer due to a vehicle suddenly igniting into flames include burn injuries (of varying degrees) and smoke-inhalation injuries. Both burn injuries and smoke-inhalation injuries can be fatal; even victims who survive the initial incident can eventually succumb to their injuries. It is also possible for drivers to lose control of their vehicle after it suddenly igniting. Losing control of the fiery vehicle could result in crashes that could cause even more injuries. Some of these injuries, associated with crashes, include the following: broken bones, neck injuries, back injuries, spinal cord injuries, pelvic injuries, lacerations, nerve injuries, sprains, etc. Regardless of the specific harm that you or a member of your family suffered due to the defect present in the vehicle, you will likely have grounds to take legal action for all harm suffered. If you would like to learn more about your right to pursue a claim, do not hesitate to contact our law firm at your earliest convenience. Our experts will provide you with the guidance that you need to learn more about your right to take legal action against those responsible for the harm suffered.Understanding Product Liability
Could you really pursue a claim against Nissan for the harm that you or a member of your family suffered due to their defective vehicles? If a defect was present in the product’s design, labeling, or manufacturing and directly caused an incident that resulted in the harm suffered, affected parties could likely pursue a claim – this is based on product liability. What is product liability? Based on product liability, all companies that manufacture and make products available to consumers have a duty of care towards their consumers. Specifically, all companies must ensure that their products are completely safe to be used by consumers. To ensure that their products are safe for consumers, companies must test and inspect their products to be able to identify and address hazards before any consumers are harmed. Companies failing to identify and address hazards present in their products represent a breached duty of care, which can result in companies being found liable of all the harm that consumers suffer. If you would like to learn more about product liability and how Nissan could be held accountable for the harm associated with their defective products, do not hesitate to seek the expertise of our product liability lawyers as soon as possible.Your Right to Sue and Receive Compensation
If you were directly affected by the defective vehicles recently recalled by Nissan, you might be interested in pursuing legal action. If the harm that you suffered was a direct result of the product defect – a defect that should have been addressed by Nissan prior to making vehicles available to consumers – affected consumers might have grounds to sue and receive compensation for all the harm suffered. Depending on the details of your claim, you could be compensated for some of the following:- Medical expenses
- Lost wages
- Pain and suffering
- Loss of consortium
- Funeral and burial expenses
- Property damages
- Punitive damages
What Should You Do?
If you were affected by a defective product, there are a number of things that you should do to ensure that you are on the right track towards pursuing a claim against the liable party. In product liability cases, there are a number of steps that should be followed, which include the following:- Take photos of all injuries suffered
- Take photos of the defective product
- Gather witness contact information
- Seek medical attention immediately
- Keep the defective product in a safe place
- Contact the company to inform them of the defect and the harm suffered
- Do not agree to a free repair
- Do not agree to any sort of monetary compensation from the company (they might offer refunds)
- Do not tamper with the defective product in any way
- Seek legal assistance immediately from a product liability attorney
The Statute of Limitations
All product liability claims are subject to a strict statute of limitations, which establishes the total length of time that claimants have to file their claims. In California, the statute of limitations that applies to product liability claims consists of just two years. This means that claimants will only have two years to file their claims. If claimants fail to file their claims within the time allowed by the statute of limitations, they will lose their right to sue – and their right to receive any form of compensation. Your claim could be subject to a two-year statute of limitations; however, certain exceptions could apply. Exceptions to your claim could result in the applicable deadline being tolled for some time. Exceptions could be made when the victim is underage or mentally incompetent, for example.
