Horseback riding accidents can be serious. Generally an individual who permits a rider to use their property for this purpose can be held liable for defective conditions that existed on the property. If the rider paid for the use of the service or was granted permission by the owner liability can be imposed under certain circumstances. If a rider was injured while on a commercial trail liability can still be imposed if “gross negligence” can be found.
Often times certain commercial establishment require a waiver to be signed which waives your rights. However, this is not always effective in denying liability.
