According to court documents the injured party was seriously injured after his horse was spooked while riding on a trail owned by Mr. Quaid. Apparently the actor had given the injured party permission to use the trail and is now being held liable for injuries sustained as a result of the accident. Horseback riding accidents can be serious. Generally an individual who permits a rider to use their property for this purpose can be held liable for defective conditions that existed on the property. If the rider paid for the use of the service or was granted permission by the owner liability can be imposed under certain circumstances. If a rider was injured while on a commercial trail liability can still be imposed if “gross negligence” can be found.
