Tree Trimming Accident Attorney
A man in his 40s was fatally impaled while tree-trimming in Canoga Park on Monday, according to officials. Crews with the Los Angeles Fire Department responded to the 7400 block of Canoga Avenue, near the intersection of Valerio Street at approximately 3:20pm after receiving reports of the incident.
Fire officials said that the man, who appeared to be about 44-years-old, was trimming a palm tree when he fell about 35-feet and landed on a 10-foot iron fence. Further, they stated that “[the] fall rendered the patient beyond medical help. An LAFD team will utilize a high angle rope system to carefully recover his body, which is currently covered by a sheet and shielded from public view by a tarp to preserve the decedent’s dignity.”
It is not clear whether the winds in the area played a factor in the incident, although video footage from the news helicopter after the incident showed the palm trees that the crews were working on swaying back and forth.

Tree-trimming is among the most dangerous jobs. Workers must go up many feet into the air to access the trees that they are working on. Some of them work on cranes while others are pulled up by rope system and secured by harnesses. These companies can exercise different safety protocols, but incidents may still happen. Some examples of the possible causes of these incidents may include the following:
-
Defective safety harnesses or safety equipment
-
Defective cranes
-
High wind conditions and other poor weather
-
Poorly trained employees
-
And more
In the incident above, the worker fell about 35 feet, landing on an iron fence, which caused fatal injuries. Even without an iron fence nearby, a worker that falls onto the floor from such a height can sustain devastating injuries, which are likely to be fatal.
No matter the cause of the incident, it is important that surviving family members understand that they could have the right to file a lawsuit.
Can I Sue the Tree-Trimming Company?Yes, if the incident was caused by the company’s failure, whether it was the failure to train, the failure to ensure that their equipment was safe, the failure to have the proper safety protocols, etc., then the employer could be held accountable and could be sued. If the incident happened because of poor weather (like strong winds) and the worker was told to still perform the job even when the weather was risky, then the employer could still be held accountable. If the poor weather was unprecedented, then liability may not apply.
If the incident was caused by defective products unknowingly used by the company, then the manufacturer of the defective product could be held accountable and could be sued.
Can I file a workers compensation claim? Yes, in cases of wrongful death as a result of workplace incidents, surviving family members could have the right to pursue wrongful death claims. It is important to reach out to an experienced workplace accident lawyer as soon as possible.
