Auto accidents can happen practically at any time. Some possible causes of auto accidents include the following:
- Driving under the influence of drugs or alcohol (or even medication)
- Distracted driving
- Speeding, weaving in and out of traffic, tail gaiting, etc.
- Unsafe road conditions (including defective traffic lights, potholes, blind intersections, etc.)
- Defective vehicles
No matter the specific cause of the accident, victims (and surviving family in the case of wrongful death) may have the right to sue.
Your Right to File a LawsuitAfter a car accident, victims and their families may have the right to file a lawsuit. The question is who they can sue. The answer to this question depends on who is liable for the accident. In general, if the accident was caused by the negligence of a driver, then victims and their family could sue the driver’s insurance company. If the accident was caused by unsafe road conditions, then victims and their family could sue the road works agency, which is usually a city entity. If the accident was caused by the negligence of an auto manufacturer, then victims and their family could sue the auto manufacturer. These are just some examples of the parties/entities that could be found liable for these incidents. Of course, it is possible for these parties/entities to share liability for some incidents.
