In general, liability for auto accidents is strictly based on the details surrounding the crash. Typically, the person who caused the crash will face liability and could be sued. However, in cases involving school buses, liability can be different.
Liability for auto accidents is usually based on the concept of negligence. Drivers owe a duty of care to all others on the road, including their passengers, other drivers, passengers in other vehicles, and pedestrians, for example. When drivers act recklessly (engage in speeding, tailgating, dangerous maneuvers, drive drunk, etc.) and cause an accident, they can be found negligent and liable for any resulting harm.
With school buses, however, there is an additional responsibility. Schools and school districts can be liable for harm to students and teachers due to bus accidents. In addition, it is important to note that school buses are considered common carriers, so their drivers are held to a higher standard of care. This means that even if the crash was caused by a negligence of another driver, anyone injured on the bus could have the right to file a lawsuit against the school, school district, or private company that owns/operates the bus.
