Can I File a Lawsuit?

Yes – you could file a lawsuit for the harm that you or a loved one suffered. Your right to sue is based on the concept of negligence. All drivers owe all others on the road a duty of care – a duty to drive safely to avoid incidents that could harm other drivers, passengers, motorcyclists, bicyclists, and pedestrians. When drivers breach this duty of care and cause accidents, they can be liable for all resulting harm. In turn, auto insurance companies could have liability if drivers have coverage.

In addition to drivers and their insurance companies, the other entities that could be found liable for auto accidents could include auto manufacturers, road work agencies, employers, etc. For more information about the legal options available to you – and your right to sue after a car accident – contact us today.
