car crash silver lake auto accident vehicle crash personal injury lawyer compensation sue

At approximately 10:35 a.m. of Wednesday, June 17, 2020, firefighters responded to a rollover accident in Silver Lake. The incident was reported in the 1600 block of North Silver Lake Boulevard. The vehicle, an SUV, appeared to have crashed into a tree before rolling over and crashing into the front of the L&E Oyster Bar (located at 1637 Silver Lake Blvd.).

One person suffered fatal injured and was pronounced dead at the scene of the accident; the person has not been identified. Two others, a 72-year-old woman and a 52-year-old man, suffered serious injuries and were transported to a hospital. It is not clear whether the victims were all occupants of the vehicle or unfortunate pedestrians that were unable to escape the collision.

The cause of the collision is still under investigation. The L.A. County Building and Safety Department inspectors were also on scene to assess the damage to the structure. Due to the county’s safer-at-home order, the restaurant had been closed; it opened in late May for takeout and deliveries only. In early June, the restaurant began serving on the patio area – the area where the crash occurred. Luckily, the restaurant was closed at the time of the incident.

The Damages Resulting from these Incidents

Without a doubt, auto accidents can lead to significant damages. In terms of physical harm, victims could suffer some of the following injuries: head injuries; brain injuries; neck injuries; back injuries; spinal cord injuries; hip injuries; pelvic injuries; shoulder injuries; knee injuries; fractures; sprains and strains; lacerations; crushing injuries; severed limbs; degloving injuries; scrapes and bruises. Depending on the severity of the incident, the injuries suffered could be fatal. In addition to physical harm, survivors of devastating auto accidents could also suffer mental and emotional harm, which could include depression, anxiety, fear, and post-traumatic stress, for example.

Without a doubt, property damage is also a possibility. In most cases, car accidents result in property damage strictly to other vehicles. However, in incidents involving collisions into structures, like restaurants, property damage to the structure is likely. Although it is possible for the damage to be superficial, such as broken windows or doors, the damage could also be severe; structural damage could deem the property unsafe and even a total loss.

Regardless of the damages resulting from the incident, it is important for affected parties to know that they might have grounds to take legal action. If you would like to learn more about your right to pursue a claim, do not hesitate to seek legal assistance with our experts immediately.

Who is Liable for Damages?

Who is liable for the damages resulting from the incident? The answer to this question depends on the details surrounding the incident. In general, liability for auto accidents falls onto the driver that caused the accident. However, although drivers could be liable, other parties or entities could also be liable. Car manufacturers, city agencies, and even driver employers could be liable.

Regardless of who is liable, affected parties must be aware of the elements of negligence which establish liability. To establish liability after an incident, you must prove the following:

  • You were owed a duty of care
  • The duty of care was breached
  • The breach of duty caused an incident
  • The incident directly led to harm

If these four elements are present, you could likely pursue a claim. You might file a car accident claim, a product liability claim, or even a government claim. As mentioned above, it all depends on the details surrounding the incident. If you would like to learn more about your right to sue, do not hesitate to seek legal assistance with the experts at our law firm at your earliest convenience.

Could You Recover Compensation?

If you pursue a claim that is eventually successful, you might have grounds to recover monetary compensation for the damages caused by the incident. Depending on the details surrounding the claim, you might be eligible to recover compensation for some of the following:

  • Medical expenses
  • Lost wages
  • Pain and suffering
  • Property damage
  • Funeral/burial costs
  • Loss of consortium
  • Punitive damages

For more information about the type and amount of compensation that you could be eligible to recover if you reach a successful claim outcome, do not hesitate to seek legal assistance with the experts at our firm immediately. Our lawyers are ready to aggressively fight for your right to recover the highest amount of compensation available for your claim. What Should You Do?

Affected parties should act accordingly to ensure that they can eventually pursue a claim. What should you do? Consider the following recommendations:

  • Take photos of any physical injuries suffered
  • Take photos of the scene of the incident
  • Seek medical attention for any harm suffered
  • Take photos of any property damage sustained
  • Seek professional evaluation of property damage
  • File an incident report with the appropriate authorities
  • Gather all insurance information and contact information of parties involved
  • Speak to witnesses present at the time of the incident
  • Gather surveillance footage that might have captured the incident
  • Collect records, including medical records, records of property damage costs, records of lost wages, etc.
  • Seek legal assistance immediately

By following these recommendations, affected individuals are gathering the tools necessary to take legal action. If you would like to learn more about the importance of following these steps, do not hesitate to seek legal assistance with our experts immediately.

File Your Claim On Time

If you are interested in pursuing a claim, you must ensure that you file your claim on time. This is because all claims are subject to a deadline established by a statute of limitations. When claimants do not file their claims within the time allowed by the applicable statute of limitations, they could lose their right to sue. What deadline applies to your claim? In general, claimants in California have two years to pursue their claims. In cases that involve city agencies, however, the deadline is reduced to six-months. To ensure that you have a thorough understanding of the deadline that applies to your claim, do not hesitate to contact the experts at our firm immediately. Our lawyers will help you file your claim on time.
