Tango Mini Strollers by Baby Trend Recalled | Product Liability Lawyer

baby trend tnago mini jazard hinges break product liability sue lawyer attorney compensation

On January 16th, 2020, Baby Trend recalled 2,000 of its Tango Mini Strollers. The strollers have hinge joints that can adjust height and allow them to be folded for easy transportation. The joints, however, do not remain locked under pressure, and may potentially collapse when there is weight placed on them. As a result, children can fall from the stroller, and parents may suddenly trip and fall as well. Four of the Tango Mini Stroller models were recalled. The strollers have the model number printed on a white sticker on the back of one of the legs. They can be identified by their distinctly colored bonnets. The models that were recalled are the following:

  • Quartz Pink bonnets have the model number ST31D09A
  • Sedona Gray bonnets have the model number model number ST31D10A
  • Jet Black bonnets have the model number ST31D11A
  • Purest Blue bonnets have the model number ST31D03A

The strollers were imported from China into California by Baby Trend. They were sold at Amazon.com and Target retail stores and online stores from October 2019 through November 2019. They cost between $100 and $120.

To date, no injuries have been reported. In order to remedy the issue, Baby Trend has recommended that all parents refrain from using the strollers and placing their children inside them. They can contact the company to receive either a full refund for the cost of the stroller or a totally new replacement stroller.

Injuries from Defective Strollers

Defective mini strollers can be very unstable during use. The weight of a small child may be enough in and of itself to cause the stroller to collapse, so when you add the weight of a parent pushing the stroller, the likelihood of collapse rises even more. Children and parents alike could both fall if the stroller collapses. It is possible that the stroller can also collapse when a sudden drop happens, such as when exiting a curb, when there’s a pothole or crack in the sidewalk, and more.

Injuries that can result from defective stroller accidents include the following:
  • Concussions
  • Closed head injuries
  • Broken bones
  • Strains
  • Sprains
  • Dislocations
  • Internal organ damage
  • Internal bleeding
  • Knee and hip injuries
  • Neck and spinal cord injuries
  • Disc trouble
  • Facial injuries
  • Scarring
  • Lacerations
  • Muscle damage
  • Nerve damage
  • Paralysis
  • CRPS
  • Coma
  • Death

It is very important that you go to all lengths to protect your child and yourself when you are walking them in a stroller. Even a small impact from a low height can cause damages that may be long-lasting. Although children are quite resilient, they may still suffer worse injuries as they generally do not know how to break their fall. Babies in particular will be strapped in, but if they are not, they may be flung from the stroller and hit their heads.

Steps to Take to Sue Baby Trend for Injuries from a Defective Mini Stroller

It may be very difficult to file a product liability claim if you do not have any experience in the legal field. If you try to move forward with the lawsuit by yourself, you may stall at the first junction. To file a defective product claim, you must establish that the company was negligent. This requires you to prove one of three points:

  • The item had a design flaw
  • The product had a manufacturing error
  • There were no hazards or warning signs on the item or on the packaging

With the Tango Mini Strollers, there was likely a manufacturing error that prevented the strollers from being effectively made. The strollers were designed the same or similar to other strollers that are commonly used. There is no fault with the way these strollers are drawn or meant to be used. However, if the joints were likely to collapse or the hinges were weak, this is likely due to bad materials being used. Cheap plastic, for instance, may easily break under pressure or even crack during shipment. If it does crack or suffer wear and tear, it will break much more easily during use.

You can then follow these steps for your lawsuit:

First, it is important that you go to the doctor to get treatment for any injuries you suffered or that you take your child to the pediatrician so that they can be treated. If you do not get any medical opinions, treatment, or notes, your claim could suffer. The longer you wait to get medical help, the more likely it is that the insurance agent handling the case will doubt the validity of it. Further, you run the risk of your injuries worsening over time, or your child’s health degrading. Be sure to also keep all medical receipts and prescriptions for your records.

You should take photos of the injuries that were suffered, as well as pictures of the defective stroller. You can take pictures of the scene of the incident, too, if it contributed to the stroller accident. If you could possibly acquire video footage, such as from a Go Pro, security camera, dash cam, or other location, you can add it to your claim. It is important that you do not try to fix the stroller or bring it in anywhere to be repaired. If you tamper with the stroller in any way you may not be able to sue. The company can claim that the stroller was broken by you and it was not defective. On a similar note you should not return the stroller or throw it away. If you return it or throw it out, you won’t have the crucial evidence you need for your claim. Simply refrain from using it and put it aside so that it can be used as evidence. If there were any eyewitnesses who saw the stroller break or who witnessed the accident, they can give you their perspectives on your case. This will allow you to strengthen your claim. If numerous parents were injured or their children were hurt because of these defective strollers, you may be able to initiate or join a class action lawsuit. Class action claims allow numerous plaintiffs the ability to recover compensation from a common defendant for the same issue. Try to locate any proof of purchase documents you have, such as the receipt or credit card statement showing that you bought the stroller. This will establish you as the rightful owner of the item. Lastly, it is important that you call a product liability lawyer who can handle your case for you. It is in your best interest to be assisted by someone who has the proper background and skill set to represent you. Without adequate representation, you may simply not advance very far in your case, and you may not get any of the compensation you or your family deserves.

Product Liability Lawsuit Compensation

The goal of our attorneys is to secure you the maximum settlement available. An insurance agent will measure the value of your case by determining how liable you were for the incident, your age, the severity of the injuries, any impact on your career, and more. He will then make you an offer based on his findings. We can negotiate a better deal until you are satisfied with the result. You may be able to receive the following forms of compensation:

  • Medical bills from the past and future to cover any treatments, surgeries, prescriptions, and more
  • Property damage to replace the stroller
  • Lost income if you were unable to return to work
  • Pain and suffering damages to account for emotional trauma, anxiety, fear, PTSD, and mental anguish

We will try to bring you every penny you deserve. It is not fair for you to have to pay for these debts and expenses if you were injured in an accident that could have been prevented. The stroller should have been properly crated and not have defects. Our lawyers promise to fight for you until the end.

Statute of Limitations to File a Claim for a Defective Product

California has a 2-year statute of limitations on defective product lawsuits. If you fail to sue within that time period, you will not be able to get any compensation whatsoever for your damages. We will ensure that your case is filed on deadline, even if you come to use in a panic.

There is the possibility that your case could be extended beyond the statute of limitations. This may happen in the event a minor is hurt and trying to sue, if the plaintiff is left incapacitated, or if the defendant has left the state. A lawyer will be able to tell you if you are eligible for any of these extensions.
