Grace Digital Recalls EcoBoulder Speakers

On November 20, 2019, Grace Digital issued a recall for its ECOXGEAR EcoBoulder Speakers. The speakers have batteries inside of them that can overcharge and explode, leading to numerous incidents and injuries. About 88,000 of the speakers were recalled. Grace Digital Recalls EcoBoulder Speakers The Bluetooth-operated speakers came in various color schemes. The speaker sections themselves were black in color, but the exterior had orange, black, yellow, red, and blue schemes. The speakers are roughly 20 inches tall and 15 inches wide. They have a storage compartment on the left side of the speaker, and the model number is GDI-EXBM900 series, with the last digit changing according to the color. The word ECOXGEAR is written on the front face of the speakers. The UPC codes are as follows:
  • GDI-EXBM900 (Orange) – code 819127010331
  • GDI-EXBM901 (Black) – code 819127010348
  • GDI-EXBM904 (Yellow) – code 819127011796
  • GDI-EXBM907 (Red) – code 819127011802
  • GDI-EXBM913 (Blue) – code 819127011819
The speakers were manufactured in China and imported into San Diego, California. They were sold for a few months at Costco stores across the country, from October 2016 to January 2017. They were also sold at Academy Sports, Cabela’s, Home Depot, and Best Buy from January 2018 through December 2018. They were sold for about $180. As of the recall, Grace Digital was informed of 5 instances in which the speaker batteries burst, resulting in fragments damaging the nearby area. Two incidents resulted in damaged property and goods. Fortunately, no injuries accompanied these accidents. Grace Digital requests that owners stop using the speakers and to not turn them on until they have replaced the battery inside. They can contact Grace Digital for a free replacement battery kit to be sent to their homes.

Injuries from Defective Batteries

Defective batteries are sneakily dangerous because they are not usually tied to many accidents. Batteries are often filled with acid and may be put under too much stress, which can cause them to overheat or explode. The batteries in the ECOXGEAR speakers can explode, and the speakers are small enough that the rest of the item can break and send pieces flying, too. If anyone is standing nearby or sitting close to the speaker, he can be hurt by the debris. Some of the injuries may include:
  • Eye damage
  • Lacerations
  • Cuts
  • Bruises
  • Abrasions
  • Flesh wounds
In addition, batteries that explode from overheating pose a fire hazard. It is possible that the speaker can catch fire and the internal wiring and plastic can go up in flames. If left unattended, the fire can easily spread and wreak extreme damage. Even a small fire can cause injuries, and burns are notorious for their extreme pain and long recovery time. Second and third degree burns, for example, may take weeks or months to heal, and the affected flesh may remain discolored, scarred, numb, extremely sensitive, or otherwise damaged in some way. Fires can cause permanent damages and may ruin your life. A fire caused by a defective battery can cause a home to burn down. It is very important that you take all necessary precautions to ensure that your house is safe and that the ECOXGEAR speaker has a working battery inside of it. If you are injured in any way because of a broken or defective battery, contact our product liability lawyers today. We will sue Grace Digital and ensure that you get paid the fair compensation you deserve.

How To File A Product Liability Lawsuit

Product liability lawsuits are forms of personal injury law and are based off negligent action the same way many other incidents are. For product liability claims, you must show that the company ho made the product is in some way responsible due to negligence. Product liability claims require that one of three situations have been present with respect to the defect in the product. They are as follows:
  • There was a design error with the item that was present from the time it was developed and should have been caught by someone overseeing the project or signing off on its continued creation
  • There was a manufacturing defect present that caused the product to be created with the issue, or the materials used were inherently defective in some way
  • There were no appropriate warning labels or hazard signs present on the packaging or on the item itself to warn of the potential dangers
The speakers did not need any warning labels concerning the batteries, and there was no reason to suspect that the batteries would overcharge or overheat. The issue was present in the creation of the speakers and the choice of materials used. The company should have sourced better batteries or ensured that they were not likely to overheat if a cheaper or different brand or style was used. Many victims of defective products do not know what to do to get started on their lawsuits or even how to gather evidence. We believe that everyone should be amply prepared for their claims, and if you have any questions, you can call us for advice. You should follow this procedure to file a product liability claim against Grace Digital: Firstly, it is very important that you go to the medical center to receive treatment for any injuries you suffered. If you don’t go to the hospital or to the doctor at once, some negative consequences can happen. For one, the injury may worsen and be harder to fix, which is a negative for your health. Further, it will look problematic on your claim. The longer the time gap between the incident and injury and the treatment, the more likely it is that the insurance agent handling your claim will reject it. He will believe that you were hurt in another incident. Additionally, you should make sure that you have all the necessary medical receipts, notes, and prescriptions. You should take photos of your injuries and any damage that happened to your home when the speaker exploded. This evidence will be crucial to your claim. You will benefit from having corroborating claims, but it may be impossible to acquire any if there were no one with you at the time of the incident. Any eyewitnesses, though, will greatly benefit your claim with their statements and testimonies. You may also be able to find individuals who were injured by their own defective speakers, and in doing so, you could join a class action lawsuit. Be sure to not return the item to the store or to the company. Do not try to fix the item or bring it to a repair shop. Do not tamper with it in any way. If you do, the company can say that you likely caused the problem in the first place. Also, hold on to the receipt or proof of purchase that you had when you bought the speaker. You may need to print your bank statement out to show that you legally purchased the item. After getting all your evidence together, it is highly recommended that you contact a product liability lawyer for help. You may not have legal experience or enough negotiation skills to win your case, and it is very likely that the insurance agent will throw your claim out without considering it. A lawyer can ensure that your case is looked over and that you are given fair treatment. We will strive to win you the maximum compensation available, as well.
