The restaurant chain Panera Bread is facing 2 lawsuits filed by families of individuals who died after consuming the company’s highly caffeinated Charged Lemonade. One lawsuit was recently filed by the family of David Brown, a 46-year-old man in Florida. His lawsuit follows an earlier case that was filed in October by family members of Sarah Katz, a 21-year-old University of Pennsylvania student.

According to an attorney for the families, Elizabeth Crawford, “We know that they would have not otherwise died and they not drank the lemonade.”

Brown passed away from cardiac arrest after having the lemonade 3 times during his visit to Panera Bread in Fleming Island, Florida. Katz died in September 2022 after consuming the beverage. Though she had a preexisting heart condition, it was “well managed with medication,” according to Crawford. She added that Katz had “long QT type one…when it’s managed with medication, there’s virtually 0% chance of a sudden death, unless there’s something else going on here.”

Panera Bread’s Charged Lemonade contains 390 milligrams of caffeine, which is about 10 times the caffeine content of a 12-oz can of Coke. And yet, “The drink is not marketed as such,” said Crawford. She contends that the beverage should be marketed as an energy drink based on the high caffeine content. The lawsuit also points out that the beverage was sold in the same area of the store as its non-caffeinated and low caffeine drinks, which can also mislead the consumer.

This is a key factor with cases involving Panera Bread Charged Lemonade, which contain gharana. Crawford said that the addition of this ingredient means that you are getting the same amount of caffeine from one 30-oz Charged Lemonade as you would from 3 Red Bulls.

In fact, the USDA recommends no more than 400 mg of caffeine per day for a healthy adult. That means one Charged Lemonade is almost an entire day’s worth of caffeine.
