The Food and Drug Administration recently issues a recall for GranuFlo, a dialysis drug commonly used for patient suffering acute and chronic renal failure.. Serious medical complication including heart attack, low blood preassigned, sudden cardiac arrest, stroke and death have been linked to the use of GranuFlo. Victims of defective drug are entitled to compensation from all at fault parties as a claim if filed within the statutorily allowed time period. Failure to file a claim in time will eliminate a victims right to recovery. What if the Time Period to File a Claim Has Run Out: In certain circumstances courts will allow for a tolling (or halting of the statute of limitations). Examples of cases where the statute of imitations for filing a case has been tolled include
- Physical or mental incapacitation of the injured party.
- The victim did not know the injury was caused by the use of a defective product until a later time.
- The injury did not manifest itself a later time after the drug use by a patient.
- Minor status of the party, under the age of 18.
