(3) Lost wages and loss of future income due to disability caused by injuries incurred. (4) Pain and suffering including emotional damage and mental anguish. Never Sign the Settlement Offer Before Speaking With an Attorney: Corporations, stores and manufacturers often attempt to settle such matters as soon as possible for pennies on the dollar in order to avoid liability for the full amount of damages incurred by the victim. There are several steps you should take if you are contact by the representative of the manufacturers of defective consumer products. 1. Never speak with the representative regarding the extent of your injuries. 2. Do not return the item to the manufacturer in return for a new product or reimbursement. The return of the product will result in the loss of evidence that is required to pursue a defective product case. 3. Advise the representative that wish to be represented by an attorney and wish for them to discontinue all future communications. 4.
