Statute of Limitations – Average Timeline to File an Injury Accident Case in California

The deadline to file a personal injury lawsuit in California depends on the party that you are suing. Generally, you would need to consider the ownership of the building, attraction, business, etc. that’s liable for your accident. If, for example, you were injured from a dangerous condition at a hotel or restaurant, you would be suing a private entity, which means you have 2 years from the accident to file your lawsuit.

But what if you were injured on a property that’s owned by the city, county, or state? Under California law, claims against the government must be filed no less than 6 months from the date of your accident. Once the applicable agency receives your claim, they have 45 days to approve or deny your payment request. If you receive a denial notice from the agency, you have 6 months from the date of rejection to file a lawsuit. If, on the other hand, the agency fails to send you a written response in 45 days, your deadline to file a lawsuit is two years from the day you were injured.
