Responsabilidad controvertida en accidentes de tráfico: Cómo probar los casos de "él dijo, ella dijo".

Disputed Liability in Car Accidents: Proving He Said She Said CasesRecently we have had a number of clients call us to discuss their car accident case. In many situations potential clients feel frustrated about how the accident really happened, and how the at fault party claims it happened. In many cases with the absent of a police report these cases can become very difficult. However, you should not be discouraged as you may have a chance in succeeding in your case. Here are some tips to consider.

Surveillance Footage Can Be Used to Prove Liability in Your Case

With improved technology surveillance footage is more readily available. Many street corners will be outfitted with surveillance footage. If you have been involved in an accident at a major intersection it is likely that a surveillance camera caught the accident. However, the important thing to remember is that you do not have access to this footage. Most property owners will be hesitant to release such information to you. It is important for your attorney to request the footage and send a notice of preservation to protect the surveillance camera. If this is not done promptly the footage can be erased or recorded over. Surveillance footage is critical to proving your case and can really help in proving liability. Always make sure you look for surveillance cameras. If you have retained an attorney make sure that they investigate the area to make sure it is properly secured.

Witnesses Testimony Can be an Important Factor in Proving Your Case in Court

Another important tip is looking for witnesses. You should always look around for a witness. This can include knocking on doors or getting the name of any pedestrian in the area who may have witnessed the accident. Often times after an accident we will visit the scene and look for pedestrians who frequent the area, shop owners or anyone who was familiar with the accident. Usually this approach will not work, but sometimes we will get lucky and the information we are looking for is available. While this is not always the case it does work every now and again.

Filing a Lawsuit in he Said She Said Auto Accident Disputes

In certain situations your case may warrant filing a lawsuit. We will consider filing a lawsuit on your behalf against the at fault party depending on the facts. If we can determine that the at fault party is not telling the truth then a lawsuit will be warranted. This is usually done when we are out of options and are left with no other choice to pursue justice. Our office has successfully filed lawsuits in cases where we felt our clients were not at fault and were wrongfully denied coverage we will file a lawsuit on your behalf. If you have been injured in an automobile accident contact our office for a free consultation.
