The Physical Assault of Children at Schools

Examples of assault include the following:

  • Empujando
  • Perforación

No matter the specific abuse that occurred, children can suffer significant harm. Possible injuries include head injuries, facial injuries, broken nose, broken teeth, broken jaw, traumatic brain injuries, neck injuries, back injuries, spinal cord injuries, fractures, lacerations, scrapes, and bruises. In addition to physical injuries, assault at the hands of a teacher can also potentially result in extensive mental and emotional harm, which can include depression, post-traumatic stress disorder, anxiety, fear, etc.

No matter the specific harm that your child suffered, it is important to seek legal assistance to explore the options available to you and your family.

Can I Sue If a Teacher Physically Assaulted My Child?

Yes, you could sue. School districts have a duty to ensure that their staff (teachers, assistants, office staff, janitors, etc.) do not pose a danger to children. There are different things that the district can do to ensure the safety of children in schools. This starts as early as the hiring process; they must subject all prospective employees to background checks. Once cleared and hired, then employees must be properly trained and properly supervised. Of course, it is also essential for the district to have policies in place – this may include zero-tolerance policies, procedures for reporting/investigating, etc. When the district fails to identify and address child abuse – and, in some cases, actively covers it up – the district could be liable for all resulting harm and could be sued. ¿Cuánto tiempo tengo para demandar?

All claims are subject to a statute of limitations. The statute of limitations determines the total length of time that claimants have to sue. If claimants fail to file their claims on time, then they can lose the right to sue entirely. In general, assault and battery claims are subject to a two-year statute of limitations. However, claims involving schools and school districts are government claims, so they are subject to a much shorter six-month deadline. After filing the initial claim, claimants can have either have an additional six months or up to two years to file their lawsuits. If you are unsure of the total length of time that you have to file your claim, contact us today.
