About the Latest Lawsuit against the El Monte Union High School District

A second lawsuit has been filed against the school district by a group of former students. The lawsuit was filed by nine women on July 24, 2024, in the Los Angeles County Superior Court. The lawsuit alleges that the nine women were sexually abused by teachers, coaches, and other staff while they were teenagers attending the school. The lawsuit alleges that the abuse occurred from 1992 to 2003. Additionally, the lawsuit alleges that student complaints of the sexual assault were ignored and that the school administration investigated but ultimately did nothing about the abuse.

One of the survivors pursuing this lawsuit claims that she was targeted by multiple school employees. She reportedly sought help from her mentor; however, instead of getting help, she was raped. The women claim that staff told them to wear revealing clothes and made comments towards students about having “bedroom eyes.” In the lawsuit, the women accuse the district of negligence, specifically for allowing the abuse the continue. Some of the teachers/staff named in the lawsuit are still district employees.

It is also important to note that some of the women did not know that they were victims until a recent article exposed the culture of sexual abuse at the high school; the article was written by a Rosemead High School alumnus.

About Your Right to Sue

Can I file a lawsuit if I was sexually abused at Rosemead High School by a teacher? Yes, you could have the right to sue. You could sue for any sexual assault that occurred at Rosemead High School while you were a student. Your right to sue for sexual assault is based on the concept of negligence, that is the negligence of the school district.

School districts have the duty to keep their students safe. They must ensure that their employees do not pose a threat to minors. This means that they must subject employees to background checks, training, and proper supervision. In addition, it is important that school districts have the necessary policies and procedures in place to address and prevent sexual abuse.

To summarize, all school districts have a duty to keep their students safe from sexual assault at the hands of staff. When sexual abuse is suspected or reported by victims, the district must take action to stop the abuse and prevent other incidents. When school districts fail to do this or actively cover up the abuse, they can be held liable and could be sued by survivors. Can I Still Sue if I was Abused Many Years Ago?

Yes, you could still have the right to sue even if the abuse happened a long time ago. It might have already been decades since you were a student at Rosemead High School; regardless, you may still have time to pursue a lawsuit for the sexual abuse that you suffered. In fact, if you are 40 or younger, you may have more than enough time to pursue a claim. Even if you are above the age of 40, you may still have the right to sue. Below, we will discuss the deadlines that apply to these types of claims.

What is a Statute of Limitations?

The term “statute of limitations” refers to a deadline that applies to all claims. This deadline determines the total length of time that claimants have to pursue their claims. If claimants do not file their claims on time, then they can lose their right to sue entirely. Ultimately, the statute of limitations is designed to ensure that defendants do not face claims that they cannot defend themselves against due to too much time passing and do ensure that claimants take prompt action. In general, personal injury claims are subject to a deadline of just a few years. However, child sex abuse claims are subject to an extended statute of limitations.

How Long Do I Have to Sue?

How long do I have to sue if I was sexually abused at Rosemead High School when I was a student? This is a very important question. Determining the deadline that applies to your claim is essential to preserving your right to sue and seek justice.

Under California law, specifically, under AB 218, victims of child sexual assault have an extended time to pursue their lawsuits. That is, survivors of child sex assault have until the age of 40 to file their lawsuits. Under this law, there is also a 5-year discovery rule. Therefore, survivors have up to 5 years from the date of discovery of the harm caused by the abuse to file their claims.

This discovery rule is very important considering that victims of child sex assault often suffer from repressed memories, so they do not remember the abuse. They might be dealing with the consequences of the abuse without really knowing the root cause. For example, they might have problems with authority figures. For those with repressed memories, the abuse may come to light after therapy, counseling, or even after having a similar experience, etc.
