¿Qué son las órdenes de alejamiento y qué puede hacer para protegerse?

Understanding Restraining Orders and What You Can Do to Protect Yourself information lawyer attorney help

If you or someone in your family is in fear of being threatened, hurt, harassed, or violated in some way by another person, the first step you can take against that person to protect yourself is a restraining order. While the most common order requested is for Violencia doméstica, there are other restraining orders as well.

Domestic violence restraining orders

This type of restraining order is used to stop someone, usually an intimate partner or spouse, from abusing the other person in the home. This abuse can be defined in a few ways: reckless or intentional attempt to cause bodily harm or injury, assault sexually, making a person fear that they will be harmed or injured by the other person, or acting in any behavior that is not welcome to the other party such as molesting, hitting, attacking, threatening, battering, stalking, harassing, telephoning, destruction to personal property, or contacting the other person by any means (mail, phone, etc) when it is disrupting the peace of the other party.

Civil harassment restraining order

This order is issued when, for no legitimate reason, a person harasses another person in any of these ways: illegal violence, a valid threat of violence, or a knowing and determined course of behavior aimed at another person that gravely annoys, alarms, or harasses that person.

Elder abuse restraining order

When there is a threat of harm, injury, or wrongdoing to someone 65 years of age or older, or in some cases between the age of 18 and 64 but have specific disabilities, an Elder Abuse Restraining Order can be issued to protect that person. This is necessary when any such person is victim of any of these crimes: neglect, abandonment, financial or physical abuse, or behavior that has mentally or physically hurt them.

Workplace violence restraining order

If you or another employee has suffered violence or a credible threat of violence that is also against the law, from another person at your place of work, this is the type of order to file. This order can affect many people as it usually involves other employees or locations involved by the same employer.
