Burning Man Sexual Assault
Burning Man is an event that lasts approximately one week (including the Labor Day holiday). Thousands of people travel to Black Rock Desert in Pershing County, Nevada and build a temporary city called Black Rock City. This is where thousands of people ultimately go desert camping every year during Burning Man. The event is focused on both community and art. It is focused on ten principles, written by co-founder Larry Harvey. These principles include radical inclusion, radical self-reliance, gifting, decommodification, radical self-expression, communal effort, civic responsibility, participation, immediacy, and leaving no trace.
Burning Man is often confused for a festival; however, it is not – there are no headliners or scheduled performers/acts. Rather, participants design/build every piece of art on display. They also plan the activities and other events that take place during the week. In fact, one of the few scheduled activities in the burning of the man; this is a ceremony that culminates the week-long event. Normally, the burning of the man takes place on the penultimate night of the event.
This year, however, the burning of the man was delayed twice, finally taking place on Monday night. The event took place from August 27 to September 4, 2023. Heavy rain near the end of the event caused mayhem – the roads in and out of the temporary city were covered in mud that was impossible for most vehicles to drive through. Because of this, event organizers released a statement urging all participants to shelter in place and preserve resources (food, water, and fuel). Still, many people attempted to leave, resulting in countless vehicles getting stuck in the mud.
According to the organizers, as of noon on September 6, 2023, participants continued to exit the even smoothly.
So far, there has been one report of a fatality – although there are no details surrounding the cause of the death. It is unclear whether there were any other incidents.

Sexual assault can happen anywhere – even at Burning Man. Even though the event is associated with overwhelmingly positive principles, many things can happen during the week-long desert camping event. Sexual assault can happen at any time, even in a crowded setting. Sexual assault can leave victims with extensive physical injuries. Of course, mental and emotional harm is also likely.
This can include the following: unwanted pregnancies, sexually transmitted infections, genital injuries, organ damage, fractures, lacerations, puncture wounds, scratches, post-traumatic stress, anxiety, fear, panic, depression, etc. Even after physical injuries have healed, the mental and emotional injuries can last a lifetime. Who Is Liable for Sexual Assault at Burning Man?This is a very important question. The truth is that, depending on the details surrounding the situation, the event organizer – and any hired third parties – could potentially be liable for sexual assault and other incidents that harm attendees. If hazardous conditions, like a lack of security, a lack of surveillance, isolated areas, poorly lit areas, or even negligent hiring/supervision of employees contributed to the incident and to the harm suffered, then the event organizer and third parties (which can include hired security companies, sanitation companies, etc.) could possible be held accountable and can be sued.
