Polaris Snowmobiles Recall Class Action Lawsuit
Polaris Industries has issued a recall for around 138,000 of their MATRYX, AXYS and Pro-Ride snowmobiles. The fuel tank on these vehicles can ignite from the electrostatic charge inside the tanks when the vehicle is in operation. This can cause the fuel tank to explode, which is a serious fire hazard for the user and innocent bystanders. The recall involves MATRYX snowmobiles from model years 2021 through 2023, AXYS vehicles from 2015 through 2022, and certain 2013 and 2014 models of the Pro-Ride snowmobiles.
The manufacturer has asked consumers to stop riding the vehicles immediately and to verify that their snowmobile is included in the recall by going to www.polaris.com/en-us/off-road-recalls/ and entering their VIN number. Polaris is offering a free replacement of the fuel tank for all affected consumers, but is this enough of a remedy when there have been 30 reports so far of the fuel tanks bursting? As an injury victim, you may be entitled to medical expenses, lost wages, pain and suffering, and other types of compensation. Any accident on a snowmobile has the potential to cause severe injuries. When the accident involves a fire or explosion, the rider or those that are nearby may end up with:
- First to fourth degree burns
- Disfigurement, such as permeant scarring
- Damage to the muscles and bones
- Nerve damage / loss of function
- Smoke inhalation
- Reparatory distress
- Seizures
- Loss of consciousness
Keep in mind that the process of building a strong and solid case begins from the moment you’ve had an accident. Make sure to take the following steps, which will help you maximize your chances of recovering the highest possible settlement:
- Use your phone to take pictures of your injuries, any property damage, and the scene of your accident.
- If there are people that witnessed your accident, ask for their contact information so you can reach out to them later for witness statements.
- Get treatment for your injuries and make sure to safeguard your medical records, along with any other documents related to the harm you’ve suffered.
- Call the manufacturer and let them know about the accident, but do not give a recorded statement or accept any offers to have the snowmobile repaired.
- Seek legal advice from a defective product recall lawyer.
At the moment, we are still in the early stage of the recall, so there is no class action claim on this case just yet. However, mass torts and class action lawsuits typically follow a mass recall that involves over 100,000 consumers. To initiate a class action or to join one of these lawsuits as it becomes available, contact us right away to speak with a class action lawyer at our office.
