Ross Store Armchairs Recall Class Action Lawsuit
Ross is recalling around 1,600 metal-framed armchairs that were sold at their stores nationwide between February 2024 and April 2024. The legs on these chairs can bend or break, which can cause the user to fall down and hurt themselves. Chairs involved in the recall have a metal frame and plastic cross-weave on the seats, back, and sides. They were sold in green and white or gray and white color combinations and measure 33 by 28 by 26 inches. The chairs can be identified by either SKU number 400266563392 or 400266563330.
Please be aware that there have been 5 accidents so far where people were injured from the chair legs breaking. Ross has asked consumers to stop using the chairs immediately and bring them back to a Ross store for a store credit of $50 or a refund, with or without a receipt.
While a refund or credit at the store seems like a fair deal at first, those with injuries deserve much more, like medical expenses, lost wages, and pain and suffering. If you or your loved one sustained injuries from a recalled Ross metal-framed armchair, contact our office to learn about your rights and legal options.
Broken Chair Accident Injuries
A collapsing chair accident can cause serious harm to many parts of the body. With that in mind, manufacturers have a duty to release strong, stable products without defective parts. If an armchair has weak legs, here are the injuries you can sustain:
- Fractured tailbone
- Dislocated shoulder
- Neck or back injury
- Hip fracture
- Traumatic brain injury
- Tearing of muscles, ligaments, and tendons
- Deep cuts to the skin
- Dental damage (broken teeth, jaw dislocation)
- Ruptured spleen
Steps You Should Take after an Accident
Remember that the steps you take after a defective product accident can save your life and ensure that you have the best possible recovery from an injury. These include seeing a doctor right away and having your injuries documented in medical records. Here are some other tips on what to do if you have a broken chair accident:
- Take photos of your injuries and the defective product using your phone or another electronic device.
- If anyone witnessed the incident, make sure to get their contact information or a written statement.
- After you have been to the hospital, keep your medical records in a safe place with other evidence
- Contact Ross to report what happened, but do not go agree to anything they offer, like store credit of a refund of the purchase price.
- Keep all your evidence in a safe place (medical bills, approved time off from work requests, witness statements, etc.)
- Contact a product recall lawyer as soon as possible.
