PIEPS Pro IPS Avalanche Transceivers Recall Class Action Lawsuit
Black Diamond is recalling around 770 PIEPS Pro IPS Avalanche Transceivers, which may have a defect with the battery compartment. It’s possible that the compartment may not have enough contact force to power the unit, meaning it will fail to turn or on stop operating during use. Either situation makes it impossible to locate victims in case of an avalanche.
The recalled units are made of black plastic with LCD screens and a yellow mark button. The product measures approximately 5 by 3 inches, and the first four digits in the serial number range from 2326 through 2445. Serial numbers can be found on the inside of the door to the battery compartment.
Consumers can contact Black Diamond directly and choose to receive a refund of the purchase price or a free repair of the transceiver. But these solutions are only acceptable to those who escaped injury or death from not being located during an avalanche. Others whose lives were devastated by injuries or the death of a family member have the right to seek medical expenses, pain and suffering, emotional distress, and other forms of compensation.

Every second counts when someone is buried in an avalanche. Those who are buried deeper than 2 meters have a 30% chance of survival, and even those who survive are often left with serious injuries to the head, neck, spine, chest, and abdomen. The rate of death is so high because there is a high risk of asphyxiation from the victim inhaling snow or from their breath that freezes and blocks the flow of oxygen.
Avalanche transceivers play a vital role in saving lives and minimizing health complications. This is why negligence by a manufacturer is unacceptable when it comes to life-saving equipment. If you sustained injuries or lost a loved one because of defects with a Black Diamond PIEPS Pro IPS Avalanche Transceivers, please contact our law firm.
Steps to Protect Your Health and Legal RightsBeing stuck in an avalanche is a terrifying prospect, and it’s more than likely that you will have serious injuries that require immediate medical attention .Aside from medical care, you should take the following steps to protect your right to compensation, which you will need to cover your medical bills and other monetary losses:
- Report the incident to the manufacturer, as this is the first step in starting a paper trail for an injury claim.
- They may try to offer you a refund or some other remedy; make sure to say no, since accepting anything from the manufacture can compromise your right to a lawsuit.
- Keep all evidence, like medical records, witness statements, and communications with the manufacturer in a safe place.
- Talk to a lawyer with experience in product defect liability claims, who can help you determine the best course of action.
A class action lawsuit is based on multiple victims being injured by the same product and coming together to file a single lawsuit. With that in mind, we need to hear from people just like you, whether you are injured party or lost a loved one because of a product malfunction. Please note that there is a strict deadline for product liability claims in California – either 2 years from the injury date or date of death. To ensure that you can be included in a class action claim against Black Diamond, contact our law firm as soon as possible.
