Inclusive Orbit Merry-Go-Rounds Recall Class Action Lawsuit
On December 26, 2024, BCI Burke Company issued a recall for their Inclusive Orbit merry-go-rounds. The recall affects approximately 415 products in the U.S. and about 6 products sold in Canada. According to the recall, number 25-080, the space between the rotating platform and the stationary outer rim can leave a gap that narrows too much; this poses a crushing hazard to children.
The recall specifically involves the Inclusive Orbit, which is a spinning play component for playgrounds; the product is similar to a merry-go-round. The affected product has three handrails and a seat. It is designed to accommodate a maximum of six children. The platform surface of the product is flush with the ground that surrounds it. The affected model numbers include 560-0042 and 560-0051. Those who own the defective playground equipment can contact the company to determine which unit they own.
The products, manufactured by Playdale Playgrounds and Imported by BCI Burke Company were sold via factory representatives directly to entities (including schools, churches, and municipalities) from April 2019 through October 2024 for prices ranging between $11,900 and $14,550.
So far, there have been two incident reports which included fingers getting trapped in the gap between the rotating platform and outer rim and both of which resulted in finger crushing injuries.
The company is urging consumers to stop using the affected merry-go-rounds and contact the owner of the equipment to determine that the equipment has already been inspected and repaired. The owners of the equipment are to contact the company to schedule an inspection and a free onsite repair.
