GIKPAL 12-Drawer Dressers Recall Class Action Lawsuit

GIKPAL 12-Drawer Dressers Recall Class Action Lawsuit sue liability lawyer attorney

On December 26, 2024, ONME Direct issued a recall for their GIKPAL 12-Drawyer Dressers. According to the recall, number 25-079, the recalled dressers are unstable if not anchored to the wall; this poses a serious tip-over and entrapment risk that can result in injuries or death to children. The product also violates performance and warning label requirements established by the SURDY Act. The recall affects approximately 800 units of the product.

The recall includes the dressers with the following model numbers:

  • HI1437_13
  • HI1437_14
  • HI1437_02

They were available in rustic brown, black, or white wood finish. They have black frames with fabric drawers and black handles. The dressers measure 31 inches wide by 12 inches long by 48 inches tall; they weigh approximately 35lbs. The product packaging contains the model number, “Fabric Dresser,” and “Made in China.”

The recalled dressers were sold exclusively at Walmart.com by OMNE Direct from January 2024 through November 2024 for about $91 each.

Affected consumers are urged to stop using the recalled dressers if they are not properly anchored to a wall and place them in an area inaccessible to children. Consumers are also urged to contact ONME Direct for instructions on receiving a refund and instructions on submitting a photo of the product being disposed of.

So far, no injuries or incidents have been reported, but there may be unreported incidents.

If your child suffered injuries or died as a result of the defective dressers, please do not hesitate to reach out to our legal team as soon as possible. Based on the details surrounding the incident and the harm suffered, you could have grounds to file a product liability lawsuit.

  • Crushing injuries
  • Broken bones, dislocations, sprains, etc.
  • Lacerations
  • Scrapes and bruises
  • Broken teeth and other facial injuries
  • And more

What Should I Do?

If your child was harmed by a defective dresser, you might have questions about what to do or what steps to take. Consider some of the following recommendations:

  • Photograph all visible injuries
  • Seek medical attention as soon as possible
  • Take photos of the scene of the accident, before anything is cleaned up
  • Contact the company to report the incident and harm suffered
    • Do not agree to a refund
    • Do not agree to return the product
    • Do not agree to a free replacement
    • Do not agree to a free repair
  • Stop using the product
    • Move the product somewhere inaccessible to children
    • Leave the product as-is (do not attempt any repairs)
  • If witnesses were available, gather their contact information
  • If home surveillance video captured the incident, gather the footage
  • Gather all medical records
  • If the incident was fatal, give the authorities all the facts to ensure that the cause of death is clearly stated in the report
  • Seek the guidance of a recall lawyer as soon as possible

Can Walmart be Liable?

If Walmart knew or should have known that the recalled drawers were dangerous to consumers but failed to remove them from their website, then Walmart could share liability in incidents and could be sued alongside the product manufacturer.
