Zinus Recalls Bunk Beds due to Risk of Injury to Consumers

On November 12, 2020, Zinus issues a recall for three different models of their metal bunk beds. Based on the recall, recall number 21-707, the welds on the bunk bed that are supposed to secure the upper bunk bed can suddenly fail; this can cause the upper bunk bed to collapse. This risk represents a danger to consumers – as they can suffer injuries whether they were on the top bunk, bottom bunk, or anywhere near the bunk bed at the time of the incident. The recall has affected 26,000 units of the bunk beds.

The models affected by the recall include the following:

  • OPLBB model – black twin-over-twin bunk beds (bed posts have square cross section)
  • RPBB model – blue twin-over-full bunk beds (bed posts have circular cross section)
  • NTBB model – gray twin-over twin bunk beds (bed posts have circular cross section)
The recalled bunk beds have ladders built into the head and foot of the bed. The model name/number can be located on a label on the horizontal bar of the upper bunk guard rail.

The bunk beds included in the recall were available online from December 2016 through January 2020; they were sold for prices ranging from $90 to $240. The defective bunk beds were available through a number of websites, including the following: www.zinus.com; www.homedepot.com; www.wayfair.com; www.overstock.com; www.amazon.com; www.walmart.com.

According to Zinus, there have been at least 13 reports of the welds on the bunk beds coming apart. In at least 3 of these reports, multiple welds failed at the same time. In addition, in at least 3 of the total reports, consumers suffered bumps and bruises after falling onto the floor from the upper bunk (directly associated with the welds of the top bunk failing).

Zinus is urging all affected consumers to stop using the bunk beds that have been included in the recall and contact them for instructions regarding receiving a free repair kit or a full refund. Should you follow these recommendations? If neither you or your family suffered harm associated with the defective Zinus bunk beds, it makes sense to simply agree to the options offered by the company. What if you or a member of your family suffered significant harm due to the defective bunk beds, however?

If either you or a member of your family suffered any sort of harm associated with the defective bunk beds, following the recommendations made by the company would be the wrong thing to do. In fact, you should only agree to stop using the defective bunk beds. But rather than agreeing to a repair kit or a refund, you should explore the legal options available to you.

Based on the details surrounding your particular situation, you might have grounds to sue for the harm that you or a member of your family suffered. • Spinal cord injuries

The risk of injuries is present for consumers that are either on the top bunk or the bottom bunk. Product Liability and the Right to Sue

Do you have the right to sue for the harm that you suffered associated with a defective product, such as the defective bunk beds? Based on the concept of product liability, you could sue. Because of the concept of product liability, companies could be held accountable for any harm resulting from their defective products. This is because all companies owe their consumers a duty of care. That is, companies have a duty to ensure that their products a duty to keep their consumers safe for their consumers; this means that companies must test and inspect their products thoroughly to be able to identify as well as address hazards present before consumers have access to the products. Unfortunately, companies can breach their duty of care; breaching the duty of care ultimately leads to consumers being needlessly put at risk of suffering harm. When a breached duty of care leads to the harm that an innocent consumer suffers, the company could be liable – this is all based on the concept of product liability.

File Within the Statute of Limitations

There is no doubt that you could be eligible to pursue a claim based on the concept of product liability; however, you could potentially lose the right to sue if you fail to file your claim within the appropriate length of time. Your claim is subject to a statute of limitations. A statute of limitations establishes the total length of time that claimants have to file their claims. If claimants do not file their claims within the deadline allowed by the statute of limitations, they could lose their right to sue.

What deadline applies to your defective product claim? In California, product liability claims are typically subject to a two-year statute of limitations; however, exceptions could apply. If any exceptions apply (based on the details surrounding your claim), the applicable statute of limitations could be tolled (or paused) for some time.
