VIQUA recalls solenoid valve kits for UV water treatment systems

VIQUA issued a recall on October 3rd, 2019, for its Solenoid Valve Kits, which are accessory kits meant to assist in ultraviolet water treatments. 70 of the units were recalled, with an additional 170 being sold and recalled in Canada. The solenoid valve could leak an electrical current, which could shock the user and cause severe injuries, especially if used underwater. The kits were meant to be used for residential and commercial treatments of water. The kits can be identified by paying attention to the ASCO parts numbers located on the green coil of the solenoid valve. The parts numbers begin 400127 and have date codes that are either 1A3 through 5A2 or 0B1 through 0B8. These codes pertain to the year and week; A is 2018, and B is 2019, while the split number shows the week number. VIQUA recalls solenoid valve kits for UV water treatment systems VIQUA distributing stores and plumbing contractors sold the kits from May 2018 through October 2019 for around $500. The valve kits were manufactured in the United States but imported into Canada. Although no instances of electric shocks were reported, the recall was issued nonetheless. Customers are recommended to refrain from using the kits to treat the water and to place it aside until they can examine it. The VIQUA website has instructions on identifying the items to determine if they are defective. If the kits are defective, consumers can call VIQUA to receive a free installation of a replacement coil to prevent electrical currents from leaking out.

Risks of VIQUA Valve Kits

UV water treatments require individuals to place kits in the water. If there is an exposed current present on the kit, it is likely that the current will be conducted through the water and cause extreme damages to the person holding the equipment. Electric shocks in bodies of water can lead to severe injuries. Electrocution damage can result in nerve damage, brain injuries, lacerations, burns, central nervous system damage, and much more. These injuries can be worsened the longer the individual holds on to the kit, or if he is completely exposed to it. The worst part of the situation is that the company is not contacting consumers to alert them to the possibility of the currents in the kits. Therefore, many users are still using the kits with no awareness of the risks.

Steps To Take To File A Product Liability Lawsuit

A product liability lawsuit is a type of personal injury claim that is based on the negligent action of a company. The company must have behaved in a way that exposed the customer to harm. With product liability lawsuits, this can be shown with one of three points. They area s follows:
  • There was a design flaw with the product that happened during the creation process or when the product was being drawn up
  • There was a manufacturing error with the product that could have been caused by machinery or improper assembly, or with the wrong parts
  • There was a lack of warning symbols and hazard signs on the product or on the packaging to tell consumers what to avoid doing with the product
With the VIQUA valve kits, it is likely that there was an error that happened during the manufacturing process. Because fewer than 300 units were recalled, it is likely that only a small group were affected. The coils that were used may have come from a bad batch or the machine could have malfunctioned during use. Either way, there was likely a manufacturing problem, an the company should have overseen the creation more diligently and attentively. If you wish to file a lawsuit because of injuries suffered from shocks due to an broken valve kit, you should make sure to follow these steps: Firstly, you should go to the doctor for treatment. If you do not go to the hospital, you will have a gap between the incident and the eventual treatment which can cause the insurance agent to doubt your claim. He can state that you were hurt elsewhere or in another accident and you were simply trying to blame the damage on the broken item. Additionally, if you do not go to the doctor quickly, your injuries may get worse. It is important that you do not let your health deteriorate – get treatment fast so you can stay healthy. Further, you should hold on to all receipts and notes from the doctor’s visit, as you will likely have proof of treatment that you can submit as evidence. Steps To Take To File A Product Liability Lawsuit It will be necessary for you to document as much of the incident and consequences as you can, so you should take photos of your injuries, pictures of the defective valve kit, the area where the incident happened, the packaging the kit came in, and much more. You can talk with others who saw the incident happen or who were working alongside you when the shock occurred. They can provide substantial support and assist your claim with their testimonies and statements. You may also be able to get statements from people who were similarly shocked; other customers could have been injured in similar ways, and together, you could create a class action claim against the company. It is very important that you do not tamper with the valve kit in any way. Do not try to fix it and do not bring it into a shop to be repaired. Do not take it apart and try to figure out the problem. Leave it alone so that the item is essentially unspoiled or untouched. Additionally, do not return it to a store or seek a refund. If you do, you will lose your evidence and you will have a harder time requesting compensation. The company can claim that you were already paid for the damages, and you should not receive an additional amount. Be sure to keep receipts and bank statements proving that bought the item. You may have even registered it online, or you may have an email confirmation and account with the company. Finally, it will benefit you greatly if you have the representation of a skilled lawyer on your side. You may not have any legal experience, which can spell disaster for your claim. Our attorneys will handle your evidence and submit the insurance claim and demand letter. We will work to bring you ample compensation for your losses. Your focus should not be on the lawsuit if you have not taken any considerable legal action in the past.

Product Liability Statute of Limitations

The statute of limitations is the time during which you can rightfully file a lawsuit. If you do not sue within that period of time, your claim will be rejected and you won’t be able to collect compensation at all. Your evidence will be better preserved if you file a claim quickly, and you will not have to worry about anything getting lost over time. Act fast so you can recover damages even quicker. The deadline to file a lawsuit is 2 years from the date of the injury. This can be extended in some cases, such as scenarios involving minors who were injured or individuals who were left mentally or physically incapacitated. You can also wait to sue if the defendant leaves the state, but the company would likely not uproot for that purpose.
