Polaris Recalls RZR Recreational Off-Highway Vehicles due to Injury Risk
On November 19, 2020, Polaris issued a recall for a number of their ROVs. According to the recall, number 21-709, the affected vehicle’s clutch can fail; this represents a significant injury hazard to consumers. The recall has affected approximately 18,400 units in the U.S.
The recalled vehicles include the following:
-
Model Years 2020
- RZR PRO XP
- RZR PRO XP 4
-
Model Year 2021
- RZR PRO XP
- RZR PRO XP 4
- RZR Turbo S
- RZR Turbo S4
- RZR XP Turbo
- RZR XP 4
The affected ROV’s were available in two-seat and four-seat vehicles, in a number of colors, including the following: lime (green), black, blue, gray, sand (light brown), orange, titanium (silver), red, and white. The ROV’s have POLARIS stamped on the front grille; RZR is printed on the sides of the ROV’s.
The defective products were available at Polaris dealers nationwide from March 2019 through October 2020 for prices ranging between $18,600 and $32,300.
According to the recall, there have been at least 136 reports of the clutch failing; these reports includes at least 8 reports of debris and clutch component ejection, resulting in damage to the vehicle. The company claims that no injuries have been reported.
Polaris is urging all affected consumers to stop using the recalled vehicles immediately and contact a dealer to schedule both a free inspection and a free repair. The company is directly notifying dealers as well as contacting registered owners.
Should you follow the recommendations made by the company? Without a doubt, you should stop using the defective product immediately. However, if neither you or a member of your family suffered harm associated with the recalled ROV, you should not agree to a free repair or any other offers (including replacements or refunds). Rather, you should seek legal assistance as soon as possible.
Based on the details surrounding the incident (including the harm that you or a member of your family suffered), you might have grounds to pursue a product liability claim. That is, you could be eligible to sue Polaris for the harm that you or a member of your family suffered. You Could Sue Based on Product LiabilityCan you sue Polaris? Do you have the right to sue Polaris for the harm that you or a member of your family suffered associated with the defective ROV’s that were recently recalled? Based on the concept of product liability, you might have the right to sue. This is because all companies owe their consumers a duty of care; more specifically, companies owe their consumers a duty to ensure that their products are completely safe for their consumers to use. They must test and inspect their products thoroughly to be able to identify and address any hazards or dangerous conditions present in their products before making the products available to consumers. Companies can fail to exercise the duty of care owed to consumers however, and they could actually breach their duty of care. That is, companies can negligently make defective products available for consumers to purchase – which puts consumers at significant risk of suffering harm.
When a breach of duty directly leads to an incident and the harm that a consumer suffers, the company could be held accountable. This means that affected consumers and surviving family members could sue and fight for the right to recover monetary compensation. If you are interested in learning more about your right to pursue a product liability claim for the harm that you or a member of your family suffered, do not hesitate to seek legal assistance with the experts at our firm immediately.

Based on the details surrounding your product liability claim, you could be eligible to recover monetary compensation for the harm that you or a member of your family suffered due to the defective Polaris RZR vehicles. What could you recover? How much could you receive? The specific type and amount of compensation that you could be eligible to receive will always be based on the details surrounding your claim; therefore, you should seek legal assistance immediately to learn more about the compensation that you could recover.
Although every claim is different, you could be eligible to recover compensation for some of the following:
- Medical expenses
- Lost wages
- Pain and suffering
- Property damage
- Funeral and burial fees
- Loss of consortium

- Take photos of your injuries as soon as possible

-
Contact Polaris
- Report the incident and the resulting harm
- Do not agree to a free repair

- Do not agree to a full or partial refund

Although you have the right to sue, failing to act quickly can ultimately lead to losing the right to take legal action for the harm that you or a member of your family suffered due to the defective Polaris ROVs. This is because your claim is subject to a statute of limitations. A statute of limitations determines the total length of time that claimants have to file their claims; if claimants fail to file their claims within the time allowed to by the applicable statute of limitations, claimants will lose their right to sue.
What statute of limitations applies to your claim? In California, product liability claims are typically subject to a two-year statute of limitations; therefore, claimants will only have two years to pursue their claims. However, it is possible for exceptions to apply – meaning that the statute of limitations could potentially be paused for some time. To ensure that you have a thorough understanding of the time that you have to sue, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.
